Germany might have only 6 month "retention policy" but your data is forever ingested into NSA's servers... thanks to BND. So whether German ISPs retain data or not, that's entirely a moot point and quite honestly, a distraction and a red herring.

What matters is whether all your data will end up in NSA's trove of data or not and whether the court systems of your country have a jurisdiction over the ISP where your data's hosted. If you live in US/Can/Aus/UK/NZ (FIVE EYES) + EU + Switzerland + Sweden and you host in any of these countries, courts of any of these countries can access your data. And your data is also copied to NSA's servers.

It's also worth noting that you have LESS RIGHTS if you host in Switzerland or Germany and you're not a citizen of those countries! If you're an American, you might as well host in the US at that point.
