Sega wouldnt do anything they love fan projects. As long as he gives the patch for free he can do what ever he wants. He is the original dev so I wonder if maybe he owns some of the rights to the game code.

Fuck me, looks like I'll be re-ordering my top five Sonic games.

Jokes aside, this is very cool. I think 3D Blast is a good game, and I'm eager to see how the improved movement turns out.
