I watched the movie Nuremberg recently.

The topic of responsibility for war crimes and aggression has been on our minds a lot, so the movie came right on time.

The Nuremberg trials were groundbreaking at the time: an international team judging citizens of another country. This set a precedent for all international criminal law that followed.

Also, the trials, the "just following orders" claims were rejected and personal responsibility for war crimes and crimes against humanity was established.

I noted the importance of proving that evil is, in fact, evil - even when it is an obvious fact (and actually, that's why there are whole teams working in Ukraine that are focused on properly documenting Russian war crimes in Ukraine). The Nuremberg trials have explicitly stated that the Nazi regime committed crimes against peace and humanity, in no uncertain terms.

Of course there are parallels with the current situation we're in, where the aggressor country has a veto voice in the UN Security Council, and its leader, officially recognized as a war criminal, is welcomed in many countries around the world.

The Nuremberg trials became the foundation for modern international criminal law. Russia's war against Ukraine underlines that the global security system has been shattered.
Will the people who committed war crimes bear responsibility for them and will that become a cornerstone of the new global security order? I would like to hope so.

Lessons of the Budapest Memorandum

(TLDR: any peace agreement for Ukraine must include strong, legally binding and specific security guarantees.)

In December 1994, a document was signed in Budapest that was supposed to become a cornerstone of Ukraine’s security. Kyiv - then in possession of the world’s third-largest nuclear arsenal - agreed to give up it voluntarily. In return, Ukraine supposedly received guarantees of territorial integrity from Russia, the United States, and the United Kingdom.

Today, against the backdrop of Russia’s full-scale war against Ukraine, the Budapest Memorandum is regarded as one of the most striking failures in modern international diplomacy.

* Why did it fail?

After the collapse of the USSR, Ukraine inherited a massive nuclear stockpile, which caused serious concern in both Moscow and Washington.

As Ukraine’s first president, Leonid Kravchuk, recalled, the West applied heavy pressure, threatening sanctions and total isolation. The young Ukrainian state, struggling with economic collapse, lacked the resources to maintain the arsenal or resist ultimatums.

On December 5, 1994, presidents of the U.S., Russia, and Ukraine, along with the UK Prime Minister, signed the Budapest Memorandum. The guarantor states pledged to respect Ukraine’s sovereignty and borders, refrain from the use of force, and avoid economic pressure.

In the 1990s, major wars seemed impossible, and Russia appeared to be moving toward democracy. But by the 2000s, Russia began returning to a sphere-of-influence mentality in which Ukraine was viewed as a territory within the Kremlin’s orbit.

The annexation of Crimea in 2014 became Russia’s first direct violation of its own commitments. Moscow claimed that after the change of government in Kyiv, a "new state had emerged" - and therefore the memorandum "no longer applied."

This argument was legally baseless, but it exposed the memorandum’s weakest point: the complete absence of any sanctions enforcement when the guarantor itself becomes the aggressor.

The core weakness of the memorandum lies in its legal nature. It was not a legally binding treaty but rather a political declaration.

U.S. State Department officials insisted on using the term "assurances," not "guarantees," which did not imply any obligation to provide military assistance.

The document contained no binding provisions for accountability if its commitments were violated. As a result, the only prescribed response was "consultations" - a meaningless procedure when the aggressor is one of the guarantors.

Even at the time of signing, warnings were voiced. Former president Leonid Kuchma recalled that France’s then-president François Mitterrand told him: "Don’t trust this document - they will deceive you."

Ukraine’s strategic mistake was failing to use its nuclear status as leverage to secure stronger guarantees - such as NATO membership or actual, enforceable security mechanisms.

The memorandum’s practical uselessness became obvious in 2014, when Russia annexed Crimea and ignited the war in Donbas. Western guarantors limited themselves to sanctions and diplomatic protests, arguing that the document did not obligate them to defend Ukraine militarily.

Russia’s 2022 invasion buried the Budapest Memorandum entirely.

"I feel a personal stake because I got them [Ukraine] to agree to give up their nuclear weapons. And none of them believe that Russia would have pulled this stunt if Ukraine still had their weapons," Bill Clinton said in 2023.

And while some ads are relatively transparent, saying that foreigners will not be sent to assault units, some are not - some of the prisoners of war told Ukrainian investigators that they came to Russia after being promised jobs in construction, in warehouses, as security guards, or as drivers.

Several regions of Russia have suspended payments to families of those killed in the war against Ukraine.

Families of the Russian soldiers killed in the "special military operation" used to receive a number of one-time benefits, including a payout to a surviving spouse (if any), or to adult children, or to parents. In addition, families were immediately given a presidential payment of 5 000 000 rubles (≈ $63,200).

On top of these federal payments, regional authorities could also provide additional benefits. For example, in Moscow and Moscow region, in Vladimir, Magadan, Novosibirsk, Tyumen regions, and Khanty-Mansi Autonomous Okrug-Yugra, the amount was 3 000 000 rubles (≈ $38,000). In Arkhangelsk, Bryansk, Leningrad, Nizhny Novgorod, Tula regions, as well as in Tatarstan and Krasnodar Krai - 2 000 000 rubles (≈ $25,300). In other regions the payment was 1 000 000 rubles (≈ $12,700).

Authorities in Khakassia suspended the "funeral payouts" reportedly due to "regional budget problems." The benefit was introduced in the republic in September 2022 and amounted to 1.1 million rubles (≈ $14,000), though its existence was never publicized. Exactly when the payments stopped is unknown.

On November 19, the head of the People’s Front in Khakassia, Kseniya Buganova, revealed the absence of such payments. According to her, the money allowed families to organize "dignified funerals," since insurance compensation arrives only about six months after the death of a serviceman.

Earlier, posthumous payments to relatives of soldiers killed in the war were also canceled in Zabaykalsky Krai. There the payment reached 1 000 000 rubles (≈ $12,700) per family, plus an additional 300,000 rubles (≈ $3,800) per child.

In order to avoid paying the promised "funeral payouts," the state simply "forgets" about those listed as missing in action. As long as a soldier remains classified as "missing," no compensation is due.

Legally, of course, families of servicemen who are missing or killed in the "special operation" may claim various types of compensation and benefits. But officially declaring a soldier "missing in action" is a very laborious and slow process (search operations - 30-90 days; court petition - at least 6 months after disappearance; then a court decision).
