At some point they decide for Mai to genuinely give him a chance and THEN we settle into the cliche dynamics shown in that page.

It's legitimately fucking weird, along with a lot of other weird ass stuff in these comics. What's funny is the writing tends to get better once Gurihiru is no longer being hired to draw them.

It's horribly reductive to look at it based on the net end result. Due process is a lofty ideal to aspire to, and being "one of the good guys" means you have the much harder job of trying to walk a fine line in doing good while respecting that process.

Only after you've already addressed the evil of incompetence that is the failure within the justice system. It is the duty of the people to hold their leadership accountable. Those who ought to be dutifully punished by the system but aren't because of corruption or incompetence are a separate issue, but also a consequence of this failure.
So long as you want to aspire to being a symbol of hope and justice, which most superheroes do unless they're anti-heroes or plain murderers themselves, they do not have the right to impose their own judgment as final on their fellow man. So long as they want to live within lawful society, they too submit to the law and accept that due process is the correct thing to do. This is why it's never so easy as just punishing the wicked. There are moral complexities that no one man has the right to make a hard judgment on.
I know that "catch and release" justice is incredibly frustrating, but that's because it's two complex issues compounding each other.
Batman isn't at fault for Joker escaping or being released; the justice system is at fault for Joker never being rehabilitated, better incarcerated, or simply executed. Even if he's mentally ill, he must be held accountable for his actions whether he fully comprehends them or not. Ignorance is no excuse, but merely a reason. Likewise, Gotham is failing at revising the justice system that keeps allowing such a dangerous criminal to walk free. If they want change, they need to make it happen as a collective.
