As someone writing some cape parody myself the difference between a good expy and a bad expy can come up to two factors.
1. A good expy is made with love
2. A good expy asks a question or tells a joke.

Some examples of questions
Brown Widow: what if Spider-Man was mutated further by his accident
Omni Man: who would Superman be if Krypton never blew up and Zod was emperor
The Deep (show): what if a non Atlantean actor had the powers of Aquaman
Statesman: what if Superman started his career during his original publication
All Might: what if Superman was injured by his nemesis and struggling to keep fighting
Alexandria: what if Superman was forced to make all the hard decisions to save the world
Sunblast: what if Homelander regretted being such a jerk

Most uses of expies are in some kind of "what if" scenario and the use of them is partially copyright reasons since they'd never allow certain stories told with these big name characters.

Imagine The Pro but with the actual Justice League. Not even in Vertigo or an Imaginary Story would DC sign off on that premise.
