So about that post in the last thread about retroactive hate crimes and stuff. I decided to actually look at the text of the Online Harms Act (Bill C-63) and the sensationalism seems pretty damn justified.What C-63 does is it adds hate speech offences to the Canadian Human Rights Act in section 13 (1). The reason why it works "retroactively" is because of section 13 (2) which reads in part:>a person communicates or causes to be communicated hate speech so long as the hate speech remains public and the person can remove or block access to it.So anything you ever posted is fair game if you have some way of removing or blocking access to what it is you wrote in the past.Now, normally violations of the Human Rights Act are dealt with by their kangaroo courts (Human Rights Tribunals) and usually lead to fines and stuff. However, C-63 also adds something to the Criminal Code:>320.1001(1)Everyone who commits an offence under this Act or any other Act of Parliament, if the commission of the offence is motivated by hatred based on race, national or ethnic origin, ...[etc.]... is guilty of an indictable offence and liable to imprisonment for life.Note the "any other Act of Parliament" bit.
