The political world was rocked on Friday morning by the arrest of former CNN star Don Lemon by federal agents in connection with a protest that saw its participants storm a Minneapolis church during a Sunday service.

In a statement, Lemon’s attorney, Abbe Lowell, revealed that he had been taken into custody in Los Angeles on Thursday evening.

“Don has been a journalist for 30 years, and his constitutionally protected work in Minneapolis was no different than what he has always done,” asserted Lowell. “The First Amendment exists to protect journalists whose role it is to shine light on the truth and hold those in power accountable. An arrest is seizure of a person under the 4th amendment. Habeus Corpus (hold the body) means that persons must be arraigned on charges or released.

He was arrested because the arresting officer had reasonable suspicion that Lemon was guilty of a specific offense, such as Disorderly Conduct defined under Minnesota Statute § 609.72. It is important that the arresting officer have a specific offense in mind during the arrest, it is not important that if a different offense is later charged.

The decision not to charge ends the detainment of Lemon. Decisions not to charge does not make the arrest unlawful.
