FMCSA 391.15 and 391.21 basically make it the prospective employers problem to show that a new driver was not employed by a carrier, or a company subject to FMCSA regulations, for the prior 3 years and that this must be completed within 30 days of hire. About the only way to show that you weren't doing something is to show documentation of what you were doing in that time which is where the work history documents become important. This is federal law btw so companies aren't just doing this to be pains. Things like this can, and do, result in multi-million dollar fines as the feds actually do audits of carriers.
