There is no legal path to move the contingency funds unless OBM signs the apportionment form which they cannot do without either a CR or an order from the president. There is no way to hold someone in contempt for failing to issue the money because it puts the person following the order in legal peril.

The judges can't write an order specific enough that it can be complied with. The ball is in their court to tell anyone HOW to release contingency funds without a CR. They can't because it runs afoul of ADA and the impoundment control act.

A contempt finding has to be WILLFUL refusal of a SPECIFIC order. The judge can't just say " produce this result or you're in trouble."
