Especially looking at the design Filian re-uses, it's just a SF outfit, and clothes (especially when you look at such a common design) are considered "functional articles" and receive no copyright protection. Jingo has a strong claim to the underlying skeleton of the model--which Filian uses without modification, as far as I am aware. However, the skeleton is not used in physical merchandise and, thus, a case brought in respect of the merchandise would have to be based on the visual parts of the model. While I do believe that the visual design of the SF model of Rindo is copyrightable, it acquires a "narrow" copyright, which prohibits only direct copying.For an example, an arcade game which depicts karate would acquire "narrow" protection--banning direct copies from being sold--but not broad protection--meaning that other companies can make different arcade games which also depict karate. Data East USA v. Epyx. That same logic applies here: Jingo's SF Rindo model acquires "narrow" protection--prohibiting the sale of direct copies--but not broad protection--allowing for other people to make other creative works, such as plush toys, with the same idea, so long as the exact form is not copied. See Gund v.
