My fucking boomer employer fired me from my construction engineering job half a year ago and they are still salty, fighting my already approved benefits. Now I am going to have to waste a morning three weeks from now talking to a judge and some third party company that represents that employer over the phone.I have never been in a hearing like this before, how does it go? I got the packet of "evidence" two weeks ago and there is nothing beyond a handful of drawing red lines that they allege means I could not perform. No written warnings, no PIPs, no transcribed discipline. Just a vague "hey we think this guy sucks" and some very standard mid-stage red lines is all. I have the option to subpoena people or papers but their evidence is so flimsy that I think I am better off just letting the lack of evidence speak for itself. The employer did not even care to fully fill out the fact-finding questions which strikes me as odd.Do employers just bullshit unemployment office to drag things out in hopes I will give up? Am I going to just be arguing against some third party goon that was not a witness to anything? Has anyone here ever been fucked by a phone unemployment hearing? I have been approved this entire time so I assume the employer has to prove their case better.

This isn't a criminal case: they don't have to prove you guilty beyond reasonable doubt. If they present no evidence and you present no evidence, the judge is just as likely to find for them as he is for you. Remember that what happened is absolutely irrelevant, here: all that matters is what you can *prove*. Collect evidence and present it; if you don't, you are fucked.
