Here's my situation. Its related to work.>get performance review. >it contains lies about certain things. >it also contains negative comments about the work my team did, but their reviews are fine while mine is mostly negative even though it was a group related thingI have to acknowledge it and sign it but can leave a comment.Wondering if it is worth pointing out the lie and biased takes in the comments. One thing to note is that I'm in America and I will need a surgery done soon. Surgery that will be cancelled if I get fired since healthcare is tied to job. I am looking for another job but ultimately need the surgery badly and plan to leave. But I have to sign this thing by this month and surgery is most likely next month. Worth giving my side of the story or should I just take it.Want to point out that I'm not adversed to criticism but in this situation, it seems heavily biased.
>>35008211>mfw someone said something mean>point it out>gets fired>dies
>>35008327>something meanBlatant lies more like
>>35008211Take the hint dude. For whatever reason, you are the odd duckling in the group. Your manager probably doesn't think you are a team fit and will look to get rid of you. >Worth giving my side of the story or should I just take it.You didn't? Typically, you submit your comments, then the manager does his side, and you guys talk about it. I would. Just know that typically employee performance reviews are not enshrined in any government standard or laws other than standard labor shit, so really if an org wants to fire you they just....can? Doubly so if they "document" the reasons for firing you.Your signature typically acknowledges that you have read and discussed the document, not that you agree with its evaluation. Refusing to sign does not stop the review from going into your personnel file. Management will simply document that you refused to sign (often with a witness) and file it anyway. Some places will discipline you for it, so ask HR I guess.Me? I'd see if you could bump up the surgery to this month and have a planned PTO date for recovery. Also, do not quit unless you have another job lined up, and start documenting everything and interactions. If they are going to fire you, let them take it all the way to terminating you completely. Don't do anything untoward or stupid, but if you learn to play your cards right you can get things like unemployment or a settlement for wrongful termination.A really good resource is Ed Hones on youtube. He's a respected employment attorney and his videos are short and good to watch, honestly perfect for a guy in your shoes.
>>35008211>>35008396Another thing is when you leave comments be factual only. If you start bringing in your opinion, drama, or some stupid bullshit it takes away from your intent and makes your side of the story less useful. So names, dates, times, and exactly what was said by who are really it. Again, watch Ed Hones/
>>35008211Also, one more thing, you can continue your insurance if fired through something called COBRA, which is a bit expensive, but still cheaper than paying out of pocket for the surgery.https://healthy.kaiserpermanente.org/shop-plans/continue-coveragehttps://www.anthem.com/individual-and-family/insurance-basics/health-insurance/health-insurance-options-after-cobrahttps://www.dol.gov/agencies/ebsa/laws-and-regulations/laws/cobraCOBRA: A way to keep your health coverage. If you’ve lost your job, had your hours reduced, or experienced other qualifying events, you may be able to keep your job-based health coverage. The Consolidated Omnibus Budget Reconciliation Act, or COBRA, is a federal law that allows workers and their families to temporarily keep their health coverage in certain situations.
>>35008396The manager is pretty new. Like a year in now. They made a bunch of process changes that didn't work at all and slowed things down. My coworkers and I did everything asked yet that wasn't enough. If it helps my point of view, all of my team are looking to leave because of this new manager. They have also told me that it is weird as even they have noticed that the manager seems to be picking on me for mistakes they make or the group as a whole. Initially I did give any side and they just got angry at me and started yelling for explaining my side of the story. Didn't tell them my opinion, just pointed out that me and my team did as asked. When their new implementation was heavily criticized by other teams, that came down on us. More specifically me for some reason. At this point I just want to leave so I haven't been fighting back to not exhaust any more of my energy.Issue is I have been looking for another job since last October now and I have gotten some interviews but nothing. Even went for minimum wage jobs just so I can leave this place but no prospects there. The thing is I want to find another job and work elsewhere but am just weighing my odds in case I have no choice to stay. Would like to move my surgery date up but it's not my choice. Surgeon is heavily booked up.
>>35008402>>35008406Appreciate the advice. Will check the dude out
>>35008211Maybe contact a union rep at thits point? Put pressure on them that they can't just fire you instantly if you are going to push back, and do it with some advice from people who should know.
>>35008211Fire Punch fan?
>>35008211Idk, I had someone give me a bad performance review once and I was like "ok" and they literally said "you're supposed to fight back." But that stopped happening when I switched jobs.
>>35008432Me again, lol.Sorry to hear that. People leave bad bosses and bad workplace processes are just as bad.Sounds like you might be best of being cooperative and signing it, and getting on good terms with HR, if possible. Officially, I would say pay a visit to an employment attorney and see what they say, but it sounds like HR knows the boss is incompetent but they can't badmouth him outright because doing that is saying the quiet part out loud, and HR never does that.>Initially I did give any side and they just got angry at me and started yelling for explaining my side of the story. Hopefully not loudly. Losing your cool in a meeting never goes well, and you pay for it in the long run.>Issue is I have been looking for another job since last October now and I have gotten some interviews but nothing. Even went for minimum wage jobs just so I can leave this place but no prospects there. At least you're getting interviews. Just curious, any idea why no offers?>The thing is I want to find another job and work elsewhere but am just weighing my odds in case I have no choice to stay.Ed Hones will tell you this too, but unless your mental or physical well-being is at stake and you can prove it, don't leave. I know it sucks, but really, I've been there, I quit with no notice and it was a fucking struggle keeping afloat, and I got lucky after three months.>Would like to move my surgery date up but it's not my choice. Surgeon is heavily booked up.Anybody else in network who can do the work? Is it specialist shit only he does and you are comfortable with him doing?>>35008535What the fuck would a union rep do besides put cards down on the table? OP needs to contact an employment attorney if anything, that way when he does strike, it's sudden and with no warning. When Union Reps get involved or you threaten some sort of action, HR acts cool, then goes back to thier desk and starts building a case, a defense. You want em with thier fucking pants down.
