The 13th Amendment of the Constitution says

During the Warren Court era where the Supreme Court was very liberal they interpreted this very broadly. And ruled that “slavery” included all the “badges of slavery” which included racial discrimination. Which meant Congress could ban private racial discrimination in hiring.
