It's from some old ass law from the interwar period about "non-nutritive objects" completely embedded within food. I think, though don't quote me on it, it was done so unscrupulous companies couldn't make, say, a bar of chocolate, shove a stone slate in the middle to inflate its weight and sell it according to that inflated weight. Customers might be tricked into thinking it's a solid bar of chocolate only to be disappointed to find a rock down the middle. However, if you can see that there's something in the center, such as in the case of popsicle sticks, lollipop sticks or the tabs that stick out of American Kinder eggs (I forgot what they're actually called, but they're not Surprise), it's legal. If it's not visible from the outside, it's not.I can understand the reason the law was passed and we're really taking the piss mocking the Americans for it. At this point, Ferrara know what they can do to get proper Kinder eggs on the American market, they just choose not to and it's not the Americans' fault. It's a good law, just taken to a silly conclusion.
