Punisher kills, Spider-man absolutely does not, Wonder Woman kills, Batman does not.The difference is the kinds of villains the heroes face. For a long time the general popular sentiment was that Marvel had more interesting heroes, but DC had better villains. Strip away the thematic minutiae and all of Spidey's villains have the same goal, so you write an interesting Spider-Man story, but you look at Batman's villains and their methods are kinda similar but the end goal is different, a Joker story is not going to be a Mr.Freeze story. Now because everything has to one up the previous thing characters like Joker need to get more and more extreme, it used to be laughing gas and back robberies, now it's slicing people's faces off.
