He's a better fighter than Batman (he would have kills Batman earlier but mistook Batman's defeat as a feint) and braver than him (when Batman trapped his arm he cut it off). The whole issue is building up to Batman not being able to punch or think his way into winning a fight, and even if he did the guy would be released by the police due to politics. It's an interesting take on "would Batman kill? When and why?" Later they retcon'd it into something that made no sense.
Batman was ok doing this stuff at the time. If a villain gets themselves killed that was on them. Joker mainly killed old rich people and henchmen so no one was wondering why Batman didn’t kill the guy who poisons babies.
