Non-American here, how does it work?
I assume computer hacking is a criminal offense, not a civil one.
I.e. the state (in the form of the police, district attorney, etc.) have to start investigating and pressing charges regardless.
Just like you can't stab or shoot someone or punch someone and then the victim says "oh it wasn't that bad, I don't want to press charges" - you will go to jail regardless.
