I checked it at the time and it definitely seemed like one of those things where they wouldn't expect to win, but they expect that the defendant wouldn't be willing to put up the money for a defence or be willing the like 20% risk that it really is deemed illegal.

The Texas Harmful Access by Computer Act is huge but mostly bans really obvious things like election tampering or ransomware. You could argue that scraping a website without using their API is illegal, and maybe it is, but that would require a very strong interpretation of the THACA, and it goes without saying that X Corp probably doesn't want a Texas judge setting precedent that unauthorized web scraping is a serious cyber crime, given that's largely how they get training data for based Grok. The Lanham Act is the main act in the US establishing trademark law, and I don't think there's a serious argument to be made that "Nitter" could be confused for "X". Even if that was the case, they could just change their name.

Against Zedeus it wasn't. Against the US hosted instances it is. The DMCA guards against software implementations designed to circumvent limitations. Nitter using bot created accounts is breaking the API limitations per account Twitter has set. The DMA in the EU covers proxying but I highly doubt it covers that issue.
