Thomas Silverstein, a former Aryan Brotherhood member, murdered five people during the early 1980s, including a prison correctional officer, and spent decades in solitary confinement. He was born in Long Beach, California on February 4, 1952. Thomas's mother Virginia Conway apparently conceived him in an extramarital affair, divorced her husband, and married Tom Conway, who was the baby's supposed real father. She then divorced him in four years and married a Jewish man named Sid Silverstein, who adopted Thomas. A small, awkward child, he was easily bullied by his peers, in part because they thought he was Jewish. Virginia was a formidable woman who would not raise a wimpy son and she encouraged him to fight back. "She was that kind of a person. If someone came at you with a baseball bat, you picked up a bat and swung at him." He ended up being arrested at age 14 for causing a public disturbance and was sentenced to juvenile detention, where he found that only those inmates willing to fight wouldn't be taken advantage of.
In 1971, Silverstein received his first adult criminal conviction when he was sentenced to four years in San Quentin for armed robbery. He served his time and was paroled in 1975. Shortly after getting out, Silverstein, his biological father, and his cousin Gerald Hoff all participated in a spree of armed robberies, stealing around $11,000. He was convicted on Federal bank robbery charges and sentenced to 15 years in Fort Leavenworth. There, Silverstein became associated with the Aryan Brotherhood and in 1980 murdered a fellow inmate named Danny Atwell when the latter refused to serve as a drug mule. For that, Silverstein was sentenced to life and transferred to the higher security USP Marion in Illinois.His murder conviction was tossed in 1985 after it came out that several prison snitches who testified at his trial committed perjury. At Marion, Silverstein was housed in solitary confinement with a nonstop ceiling light so he could be monitored on security cameras at all times. He was allowed two phone calls a month and received his meals through a slot.
In 1981, Silverstein was accused of murdering Robert Chappelle, a member of the D.C. Blacks prison gang sentenced to life for the murder of a Connecticut police officer 17 years earlier. He and fellow Aryan Brotherhood member Clayton Fountain were both convicted and Silverstein received an additional life sentence, but denied having killed Chappelle. While he was on trial, the Federal Bureau of Prisons transferred Raymond "Cadillac" Smith, the national leader of the D.C. Blacks, from another prison to the segregated unit in Marion. Smith began trying to off Silverstein almost from the moment he arrived. Silverstein insisted he didn't kill Chappelle, but Smith didn't believe him and boasted that he would take him out. The guards did nothing to separate the two; as Silverstein claimed, "They wanted one of us to kill the other."On September 27, 1982, Silverstein and Fountain stabbed Smith 67 times with shanks, then after he was dead, dragged his body up and down the catwalk in front of the cells so other inmates could see what they did. Silverstein was convicted of murdering Smith and received another life sentence.
On October 22, 1983, Silverstein murdered 51 year old correctional officer Merle Clutts. After being let out of his cell to shower, he tricked Clutts into going ahead of him so that he was between him and other C/Os. He stopped outside the cell of inmate Randy Gometz, who handed him a shank and used a homemade key to unlock Silverstein's handcuffs. The latter then stabbed Clutts to death. Silverstein said it was revenge for Clutts continually harassing him, one reason that Clutts confiscated and destroyed some of his paintings (as it was prison policy to confiscate inmate artwork if it depicts murder).A few hours later, Fountain used a similar ruse to murder another C/O named Robert Hoffmann. The spree of murders angered Attorney General William F. Smith, who called upon Congress to reinstate the Federal death penalty, which had been suspended for the last 20 years. Smith believed inmates serving life sentences felt free to kill with impunity since they could not be sentenced to death for it. USP Marion was put on indefinite lockdown, which ended up lasting until 2006. Silverstein was transferred to solitary confinement in USP Atlanta with the status "No human contact." Fountain passed away in 2004.
During the 1987 Atlanta prison riots, Cubans housed in USP Atlanta freed Silverstein from solitary confinement and after one week gave him over to the FBI's Hostage Rescue Team. Prison officials feared that Silverstein would murder C/Os held hostage by the Cubans. Prior to their handing him over, they released him from his cell and he roamed the prison feely. One of the prison guards, knowing Silverstein's reputation, had always been careful to humor him, including asking if his handcuffs were too tight. During the riot, Silverstein encountered this guard and spared him. Hostage negotiators convinced the Cubans to hand him over, which was an easy decision to make as he was peripheral to their aims during the riot. He was moved back to Fort Leavenworth and stayed there until 2005, when he was moved to the ADX Florence supermax facility in Colorado.Silverstein claimed the "no human contact" status was an act of vengefulness against inmates who kill C/Os. A Bureau of Prisons official said that since there was then no active Federal death penalty, they had no choice but to make Silverstein suffer as much as possible to discourage others from murdering C/Os.
Ted Sellers, an ex-con who met Silverstein in prison, said he was considered a legendary figure at Leavenworth. "He's not as bad as they portray. Sure, he's dangerous if they push him to the wall, but there were some dirty rotten guards at Marion. They would purposely screw you around. You're dealing with a person locked up 23 hours a day. Of course he's got a short fuse." Silverstein appealed his conviction in 2014 on 8th Amendment grounds, but the 10th Circuit Court of Appeals ruled that due to the extreme nature of his crimes, long-term solitary confinement constituted an appropriate punishment.The court's opinion stated that Silverstein murdered three people, was implicated in two others, assaulted prison staff, tried to escape by posing as a US Marshal, and possessed homemade weapons and lock picks. His violent behavior and longtime involvement in the Aryan Brotherhood made this a case where the punishment was fitting for the crime.Silverstein passed away May 11, 2019 in St. Anthony Hospital in Lakewood, Colorado, after undergoing heart surgery. Norman Carlson, the Federal prison director who issued the total lockdown order for him, admitted that his treatment had been harsh, but there was no Federal death penalty when the murders were committed and they had no other options to deal with him. "I don't know what else could have been done to prevent further violence by a man who had nothing left to lose."
