This is where things like brands and intellectual property come into play. Official content is still merchandise of the Touhou series. That is, a physical CD is merchandise whereas the music itself is the original work. I'm not sure if branded merch(merchandise featuring a label or icon of a brand) has a specific name other than branded merch, but that is probably what you are thinking of when you say merch. In a way it's merch of two things at once since Fumo is a label that doesn't necessarily have to be limited to Touhou works, so it's also arguable that it's just Fumo brand merchandise and not even merch of merch at all.
