I've seen a lot of conflicting information over the years about solvent traps, dry storage cups, and how the ATF treats various designs and parts. For those who have followed the legal developments, what is the current state of federal law regarding possession, sale, and modification of these products? Have there been any notable court cases or regulatory changes that people should be aware of?Looking for discussion of the legal landscape, not build instructions.
I don't know the answer but I can tell you that not one average joe in the history of the NFA has been arrested, tried, and convicted of NFA violations without any exacerbating circumstances i.e. violent crimes or interstate commerce violations.Make of that what you will.
>>65273631That's a good point.
>>65273511>Have there been any notable court cases or regulatory changes that people should be aware of?Diversified Machine was caught making unregistered silencers and SBRs but everyone who bought anything from them (kits, parts, etc) received a letter from the ATF stating they were sold a unregistered suppressor/suppressor parts that should have been on a Form 4. So anyone who did a Form 1 using DM's solvent trap kit before hand was automatically a person in possession of a unregistered suppressor regardless of their Form 1 status. The biggest take away is you have to be very careful in your wording in the Form 1 regarding what parts and materials you are using. Mentioning any threaded tubes or solvent trap "cups" is basically going to be a insta-denial and you'll probably end up on one of their agents radar. "Cups" with center punches or anything that marks the center of the cup where one might drill it to turn it into a baffle is also a suppressor part.
>>65273511The ATF has been bitchslapped multiple times by multiple courts regarding their "readily convertible" theory of what constitutes a silencer. That doesn't mean you're safe. It means the ATF will probably try the same stunt again.
>>65273511>>65274286No, this is incorrect, you can form 1 them. I personally filed a form 1 earlier this year explicitly stating that it was a monocore solvent trap and that the only modifications I would make would be to replace the end cap and engrave a serial number. Approved without issue.
>>65274911Show us the can and approved form 1 (sanitized of course).
>>65274919Haven't actually "made" the damn thing because I can't get ahold of the "fuel filter" supplier, but here's the approved form 1
