Rep. Andrew Clyde: I’ve received confirmation from the Trump Administration that the DOJ will NOT appeal our historic court victory against the NFA!

ATF GLOWNIGGERS IN SHAMBLES! THE RULING GOES INTO EFFECT AT 12:01 AM CDT!

Very important question. Are oil filter suppressors legal?
>>
>>65418747
This isn't a good thing, OP. By not appealing, this case won't make it to the Supreme Court, who could strike down the NFA nationwide. And because of how narrow the ruling here is, all it will take is for the Dems to reinstate the tax on SBRs and we'll be back to square one.

The DOJ has turned a possible abolition of the NFA into at best a 2-year holiday in the 5th Circuit states.
>>
>>65418759
you niggers can't take a win when you get one, even if it's a small one. This ruling will open the floodgates and make it impossible for the ATF to regulate suppressors and SBR's under the NFA
>>

someone just has to get arrested and cite court precedent, the judge has to be like nu-unh! and then they tussle in court, and the supreme court comes in with the steel chair

Starting 12:01am on August 13, 2026, a federal court order takes effect. We sued the ATF, we won, and Silencer Shop
customers win with us. Get a suppressor or an AOW from Silencer Shop in a state without a state-level NFA requirement and
you can skip the Form 4.

Fill out a 4473. Pass a NICS background check. Take it home, same as any other firearm.
No Form 4.
No registration.
No wait.

The protection exists because the product came from Silencer Shop. The court's order covers Silencer Shop customers, so buy
directly from us or from a Powered By Silencer Shop dealer stocking inventory that originated with Silencer Shop, and either
way you are inside the order.

Twenty-seven states do not require NFA compliance at the state level. In those states you are done at the 4473 and you walk
out with it. Fifteen states still require a Form 4 under their own state laws. We are fighting to get those changed, and until
then we handle the NFA paperwork for you like we always have. Full state-by-state list is on our blog.

One correction from last week: short-barreled rifles and short-barreled shotguns are covered by the order, but they still
require a Form 4 in all 42 states. The GCA is a separate law from the NFA and it still requires Attorney General approval for
those items, and right now the Form 4 is the only form that gets you that approval. We are working with ATF to create a new
form for this limited purpose.

This is a federal court ruling, so yes, this is legal. We will always shoot you straight: the government can still appeal, and if
anything changes you will hear it from us first. Buying from Silencer Shop keeps you inside the court's order while the case
proceeds.

So no unregistered SBR's. That sucks.

States where you can get a unregistered suppressor:
>>
I hope this is the first nail in the coffin for the NFA overall. Imagine the bright future we could have, anons.
Buckets of 10$ DIAS by the checkout counter at the LGS.
Civilian machine gunnery matches.
Civilian mortar competitions.
Kel-Tec snorting a metric ton of coke and creating the wackiest AOWs ever constructed.
Super effective silencers created using 3D metal printing, covering a whole wall of the gun store...
>>
>>65418878
>>65418866
Or just buy your cans and sbrs from silencerco and psa.
>>
>>65418944

So, assuming that the free state that you travel to allows suppressor sales to nonresidents, it's a s simple as driving there, buying it, and taking it back to your home state that would've still required the form 4 if you were buying it there, huh?
>>
>>65418990
You dont even own a center fire gun mr gonzalez.
>>
>>65419026
No because interstate sales would still require the dealer to follow the law of the state you are a resident of. Now the big problem is that if your state requires NFA registration and the resident of a non-NFA state comes in with a silencer would you be screwed?
>>
I'm not big into guns. Can someone explain what is happening to someone who's isn't in the know with all the gun talk please.

>The DOJ has turned a possible abolition of the NFA into at best a 2-year holiday in the 5th Circuit states.
>in the 5th Circuit states.
Geography has nothing to do with this ruling. The injunction is for the plaintiffs (GOA and its members, PSA and its customers, etc.) wherever they are physically located.
>>
>>65418973
GOA gets membership dues.
>>

The importance/value of "in common use" is massively misunderstood and overblown. Simply having a bunch of a certain type of gun/equipment in circulation does not provide the legal protection that the online 2A crowd thinks it does. It's a nice stat to be able to cite, but it's not a magic feature that deletes gun regulations.
>>
>>65419028
Who says I can't put one on my musket? It's possible.
>>
>>65419060

>>65418816
Again, location does not matter for this ruling. If you are a member of the GOA, or buy from PSA/Silencer Shop, you are protected by the injunction. It's not limited to Texas, Louisiana, Mississippi, etc..
>>65418837
>You can't expect them to understand legal precedent.
In fairness, a district court ruling doesn't really set precedent legally. Not in a meaningful way.
>>65418866
Yes, if you are a member of GOA, or are buying from PSA/Silencer Shop.
>>65418893
Today's development has positives and negatives. This is objectively the biggest dent ever made in the NFA. This is really good. However, many people wanted it to advance through the court system so it could create stronger precedent and perhaps ultimately be eliminated by the SCOTUS. Doing that would have risked the case losing on appeal/at the SCOTUS, so it's a trade off. Saying this is a loss is retarded, but there is truth to the idea that we could have gone farther and gotten more out of it.

This is a huge victory, but we still have a long way to go; and Silencer Shop will continue to lead the way along-side GOA, FRAC, ASA, Silencer Shop Foundation, and the many other groups who are working to unwind the NFA. We're truly humbled to be part of such a monumental event."
>>
How about forcing customs to stop seizing airsoft lowers?
>>
>>65419252
Lauren Spivey, CEO of Silencer Shop Foundation, issued the following statement:

"This win belongs to the people and customers who made it possible. The Silencer Shop Foundation is funded entirely by supporters who believe law-abiding Americans deserve to exercise their Second Amendment rights, and their support let us take this fight to the ATF and win a strong ruling from the court. We're proud of what we've done together, and we'll keep working to ensure all lawful Americans are protected under this ruling."

Jamin McCallum, Founder and CEO of Palmetto State Armory, issued the following statement:

"Today marks more than the first NFA-free suppressor transfer under this injunction, it marks the moment years of fighting became real for the American people. We're proud to have stood alongside Gun Owners of America and others who made this victory possible, and we'll continue fighting to expand freedom and defend the rights of everyday Americans."

Wes Virdell, Member of the Texas House of Representatives, representing District 53, issued the following statement:

"It's hard to believe we have moved the needle so far. What was once considered unachievable is now a reality, because of Gun Owners of America and Silencer Shop. GOA never gave up the fight to get here. I am grateful to be a part of this history happening right before our very eyes."

Right, but if the intention is to completely eliminate form 4 processing at a federal level for suppressors these states will be orphaned from purchasing any new suppressors. Obviously any transferred with a form 4 would still be compliant under state law. So, in effect, we have lost ground rather than gained it, should the intentions of this whole thing play out.

When there's a conflict between state law and federal law, the more restrictive takes effect. That would be the state law. Which means you potentially have a conflict between two states, or state law and federal law. That means it SCOTUS has jurisdiction. That's the ultimate goal, I assume.

Is this your first time thinking of this. These are old questions. A rifle (could) not be turned into a pistol. A pistol (could) be turned in a rifle.

If you got into a legal tremble involving your AR that is known by serial to have been a rifle upon manufacture and you slapped on a brace and pistol length upper you could have gotten hit with NFA violation. Are there any cases of that? Never heard of it but buying a stripped lower and throwing the same parts on? A OK.
>>
>>65419488
No, I already knew all of that and have thought about it a lot for my own uses in the past 10 years. I'm asking what has changed now since it is past midnight
>>
>>65419464
The ruling only applies to the registration requirements of the 1934 NFA. Transfers of SBRs and SBSs is explicitly regulated by the 1968 GCA. It's literally the whole basis of having to file a 5320.20 for interstate transport of SBRs and SBSs but not silencers, since they are not mentioned in the statute.

>>65419466
Just don't put a VFG on a pistol lower without a stock. AOWs are not covered

>>
A part of me wants to think that the DOJ and ATF didn't appeal this ruling because it's super murky and unclear. The murkiness could allow the ATF to begin mass dog-killing raids on homes of uninformed people who cut their shotgun barrel thinking it was now not needed to register for the NFA

if a tax has to be above $0.00 to qualify as a tax, then the gun owners of america are right and are protected.
in order to make the fee $4000 would require new regulation to specifically corral these new owners spawning like polyps all over the country

If you
1. Purchased the pistol/rifle/shotgun from PSA, past or present

You can convert the firearm to a short barrel rifle/shotgun with no Form 1 procedure.

Manufacturer does not matter. The legal firearm must be purchased from PSA, parts from PSA do not qualify a firearm from a different seller. You still need to comply with state regulations on SBR/SBS.

You can make an SBR if you're a customer of any of the plaintiffs. If you want to transfer an SBR, you need approval from the AG. Approval is explicitly granted with an approved Form 4, but if you really don't want to fill one out, you can try asking nicely. Once upon a time, the Form 4 process didn't automatically give this approval so people had to do that, too. Sometimes it even worked.

My current understanding from having read Section 5 "Remedy" of the actual ruling in "Silencer Shop Foundation ET AL, Plaintiffs v. BATFE et al, defendants" is that being a GOA member ALONE, current or future, qualifies an individual for injunctive relief meaning that the defendants, the BATFE et al, are legally prohibited from enforcing the SBR, SBS, Suppressor and AOW form 1 and form 4 requirements against said plaintiff (GOA members)..... As a GOA member and subject to state law... You can manufacturer as an individual not for purposes of sale SBR, SBS, AOW, and Suppressors without F1... Similar to making an 80%->100% AR lower has been in the past. ... It should be noted that you don't have to be a customer of PSA or Silencershop or other commercial plaintiffs to receive injunctive relief IF IF IF you are a GOA member (current or future)

Ehhh.... What I heard in their most recent IG video was that Oi Vey be a good goy and buy your lower/firearm from us and be a GOA membah and you can make your SBR/SBS without F1 (assuming good to go with respect to wrt state law).... when the reality is you could just be a GOA member and do the same.... you don't NEED to have bought the firearm/lower from one of the commercial plaintiffs.

>>65420203
+1
But PSA in their recent video on IG made it sound like you had to have bought the firearm/receiver/pistol/shotgun from them.

>>65420238
Smoove is fast!

>>65420250
Lol right faggu PSA doing faggu PSA shit

>>65420266
Except that is bullshit, so long as you're in accordance with state law, if you're a GOA member you can manufacture or reconfigure an already manufactured firearm/rifle/pistol/shotgun into an AOW, SBS, SBR etc (and this applies to suppressors also) without ATF Form 1..because the injunctive relief specified by the ruling prohibits the ATF from enforcing the NFA without the tax.
>>
>>65420238
The ffls are probably the bottleneck, they are waiting for atf guidance on how to handle all this. There's tons of paperwork questions on their end, like form threes they have to fill out by law that may not apply anymore.
>>
>>65419510
You could argue that I am in compliance with the NFA by being a plaintiff and therefore exempt from PAs banned "offensive weapons"
>>
>>65420328
>Except that is bullshit
kek I know it's just funny to meme my PSA lower that cost less than my trigger assembly
>>
>>65420202
No it’s because of something in the 1968 GCA that requires existing SBRs and SBSes to still be transferred with Form 4s. You can buy a 12” upper from PSA and slap it on a lower or put a stock on your existing pistol if you’re a GOA member without filing a Form 1 now since that counts as “manufacturing,” not transferring. You only need a Form 4 now if you buy an SBR direct from a dealer.
>>
>>65420346
But do you want to argue that in court? Someone should but it's a tough haul, ideally they should just amend the state law. There is tremendous interest in this, that might not be an insurmountable task if you can get some traction on social media calling on legislators for change, hell if you and a group of friends call them you might be able to move the needle.
>>
>>65420338
Agreed. I would be nervous to get too crazy. On the plus side this means we may avoid a huge run on cans and production can ramp up in a less frustrating way
>>
So can you buy a suppressor in a state where you’re not a resident? Like how Californians can buy 30 round mags in Nevada? Or is that still frowned upon.
>>
>>65420379
Silencers are still legally considered firearms that require Form 4473 to transfer so probably not.
>>
>>65420379
I think that you still have to fill out a 4473 for a suppressor, meaning the FFL probably won't sell you one if you're from out of state. Same as a firearm.

>>
>>65420434
If you buy something like what’s in your pic then basically nothing changes because it will still have to transfer to your LGS on Form 3 if you buy it online, and then transfer from your LGS to (You) on Form 4 unless the Attorney General says he will now accept Form 4473 for approval in lieu of Form 4.

>>
>>65418973
My understanding is if you buy it, yes. You need a form 4 for the transfer. PSA said if you buy an SBR directly from them you’re good, so I’m admittedly confused.

Form 1 registration is gone though. So buy a shotgun and chop it, or buy a lower and slap a pistol upper on it and your good. I think.

>>
>>65420640
If the specific state law referred to a federal approval scheme that didn't exist, you could go at it from the angle of it being invalid because of a lack of due process to comply but that would be kind of tough because as far as I know the ATF is still accepting form 1s/form 4s. I think you'd be better off trying to get them repealed at a local level or getting the ATF to gut their form 1/4 process and making it like a 4473. The state level legal battles in the courts could take years and years anyways and there's nothing blocking them from just outright banning NFA items like New York does
>>
>>65419614
In my understanding yes. It removed form 1s so you can make your own suppressors, SBRs, and SBSs without registration. Probably best to get a GOA membership to cover your ass just in case.

>Probably best to get a GOA membership to cover your ass just in case
Jesus fuck did you even read the ruling? Being a GOA member is not a just in case cover your ass, it is a necessary condition in order to be subject to the injunctive relief specified in the remedy section of the ruling. Only plaintiffs in the case (GOA members current and future) are subject to the injunctive relief. You MUST be a GOA member or otherwise be a plaintiff in some other capacity (read the fucking ruling) to be able to manufacture an SBR, SBS, AOW, or Suppressor sans ATF NFA Form 1 submission and approval.

Come on people. READ.

This is a curious consideration. I believe that it is at least possible that in states that allow for private sales between non licensed individuals... if both individuals are considered plaintiffs in the current case (GOA members etc), then perhaps SBS, SBR, AOW, and suppressors can just be "transferred" between the two private parties like any title 1 firearm previously could be. The reasoning is just an extension similar to how now the individual private manufacture of SBS, SBR, AOW, and Suppressors FOR A PLAINTIFF if the case is not subject to ATF NFA Form 1 requirements, it is treated like the private manufacture of any title 1 firearm

The plaintiffs also included PSA customers. Of which I, and probably everyone here, is.

For anyone willingly to risk it, and on the outside chance you’re somehow arrested because you shot an SBR at a range and happened to have an overzealous cop, you are almost certainly going to win a legal battle and get suppressors removed from the NFA nationally. There’s no argument to why a GOA member and a non-GOA member are treated differently. I don’t want to be the guinea pig, but I’d win.

You only need to either be a GOA member OR a PSA customer"

"6 hours ago@jacobstrawn4174the commenter is correct. The video is just lying. PSA wasn't even the lead plaintiff."

"5 hours ago@jacobstrawn4174 if this were true, you would have to satisfy being a member of every single plaintiff LOL. This video is infact incorrect. You can be a GOA member and turn any ar pistil you own into an SBR. Doesn't have to be from PSA."

Got a good goy here!
"@MalfeasanceQ 8 hours ago (edited) They probably (and rightly) want to get as many people to buy their firearms from them to SBR. They have a company to maintain and keep alive after all and attorneys cost money. "

"@Endmonaut 8 hours ago If both Palmetto State and GOA were plaintiffs in this suit, why would you need to fulfil both conditions of buying from PSA and being a GOA member? Shouldn't one of these suffice?"

"@winstonsyme
1 hour ago You don't. PSA is trying to make sure you buy only from them so they can maximize sales. If you're a GOA member you don't need to buy from any specific merchant. If you're not a member you have a limited list of options to buy from."

@LonginusModus 4 hours ago They are using their injunction to promote people to purchase from them, simplifying it for the simple minded and easily influenced.

Except a couple supreme court rulings but those are worth about as much as the paper they're written on in 2008+18.
>>
>>65418747
Commiefornia fag here.

There's something I find interesting about this new ruling because of the AOW loophole we currently have here in faggot central. Pretty much all NFA items for the exception of AOWs are illegal. But I think I been thinking about is that since this ruling essentially allows for unlimited unregistered AOWs, no Form 1s required. So long you are a member of the plaintiffs. The question I been thinking, is that now if the route in California if you wanted to get something closest to an SBR is get yourself an AR lower registered as a single shot pistol and slap a VFG on it, then convert it to semi-auto without the requirement of a Form 1. So long as you can prove yourself to be GOA member.
>>
If there’s anyone familiar with the business side of things, can you answer a question for me? Do dealers that deal in NFA items keep separate books for NFA and regular guns? If so, could it be a potential issue with a suppressor coming in on a Form 3 last week and leaving as just a regular firearm with a 4473 today? I don’t foresee an issue with this administration, but I can definitely imagine a world where some grabber president comes in and fucks over dealers over mismatched paperwork.

>>
>>65421765
This is one of the primary reasons most dealers are not simply jumping in both feet first when it comes to transferring suppressors via 4473

>>65421785
Do not I repeat DO NOT regurgitate PSA's self interested misinformation. You do NOT need to have purchased the firearm/pistol/shotgun or 80% suppressor kit lol from PSA in order to make an SBR, SBS, AOW, or suppressor without form 1 registration as a plaintiff granted injunctive relief by the ruling. Read the ruling yourself.

Being a plaintiff in any capacity, for example just being a GOA member current or future, grants you injunctive relief from the challenged NFA provisions of which are included USC 5822 which is what codifies the Form 1 requirement. You can make your SBR or SBS out of a pipe and a nail if you want... No Form 1 required (subject to state and local laws).
