ATF Releases NFA guidance in response to the Texas NFA lawsuit:

"Effective October 9, 2026, ATF will no longer require individuals to seek ATF approval under the NFA before making or transferring short-barreled rifles, short-barreled shotguns, silencers, and “any other weapon[s]” as defined in 26 U.S.C. § 5845(e). ATF will also no longer require such items to be registered in the National Firearms Registration and Transfer Record. These policies apply uniformly to anyone otherwise subject to these requirements, not just to the plaintiffs in the litigation."

In the past you didn't have to register machine guns, until one day you did. All those pre-registration machine guns didn't get grandathered, they got registered. It should be, but this quick history lesson shows that it is not, impossible for the government to impose an ex post facto criminalization scheme. Hopefully Congress will clear it up (doubtful due to the anarcho-tyrranical implications of leaving an unenforced law on the books in case they need it later) and in the meantime collect as many as you can and pray for the best.

This was nothing to do with mil requirements, it's about tax. The only reason that the NFA was at all legal is that it was a tax and not a control (which is BS but that's how they pushed it through). The tax has been set to zero, therefore it is now just a control which is illegal. The court case was specifically about suppressors but the ATF have issued guidance covering everything except MGs because the alternative is that they all get challenged one by one.

The ATF is enjoined from prosecuting certain people and organizations for violations of the NFA, but the NFA is absolutely still law of the land, and the protection from prosecution can change in an instant, and since mere possession is a felony it won't matter that you got your silencer or SBR during the pause in prosecution, it will be your possession *now* that gets your dog and wife shot.
