What to know: Ukraine is seeking to dramatically expand the role of foreign recruits in its military, with Defense Minister Mykhailo Fedorov saying the government aims for foreigners to fill up to half of all assault and infantry positions.

Ukraine plans to open its military recruitment system to foreign nationals and aims to have foreigners fill as many as half of all assault and infantry positions in its armed forces, Defense Minister Mykhailo Fedorov said.

The proposal is part of a broader effort to strengthen combat units while reducing the burden on Ukrainian troops fighting Russia’s full-scale invasion, Fedorov said in a statement.

“We are opening the foreign recruitment market to strengthen combat units and preserve the lives of Ukrainian service members,” Fedorov said.

According to the minister, the government’s goal is for foreign nationals to occupy between 30% and 50% of assault and infantry positions in the Ukrainian military.

Russia's use of foreign troop isn't a secret. Denying it is denying water is wet. Their support from North Korea is something they've touted and they openly recruit in the Caribbean and Africa.

The key legal term is international armed conflict. This is in contrast to an internal armed conflict like a civil war or normal criminality.

For an international armed conflict the combatants can have legal protections if they follow international humanitarian law, and may be prosecuted as a criminal if they don't. Overall, in the realm of sovereigns, power is what matters and nobody is holding russia to the international conventions except through sanctions.

If the declaration matters, then Russia still isn't in a state of war as they have to this day maintained the "it's de jure just a special military operation" stance. If invasions trigger a state of war, then Russia and Ukraine were already at war and the treaty can't be applied retroactively.
