The standard for a grand jury is simply "is it more likely than not that this person did the thing" and there's no defense. The prosecutors are the only ones making a presentation and don't have to show any exonerating evidence. The fact that they actually fail to convince a grand jury in any case is a real testament to their incompetence.

You may notice that the fact that these two events are timestamped in the opposite order is not mentioned, nor is any clear video of him actually rummaging around at the bottom of the pool with a knife.
