A federal judge seems likely to rule that President Donald Trump and Defense Secretary Pete Hegseth overstepped their authority when they ordered federal agencies to stop using Anthropic’s technology and designated the artificial intelligence company a national security risk.

California-based U.S. District Judge Rita Lin — who issued a ruling in March to pause the company’s designation as a supply chain risk — said during a hearing Thursday that the administration’s case seems to have “gotten worse.”

“I don’t see additional evidence from the government really justifying what it did,” Lin said.

The legal dispute follows Anthropic’s longrunning clash with the federal government over the company’s position that its technology should not be used for lethal autonomous weapons or mass domestic surveillance. Trump administration officials have said the company should remove those usage restrictions.

Attorneys for the government have said the supply chain risk determination was due to concern about what they described as “AI model poisoning” — the possibility of Anthropic secretly altering its models after agencies deployed the technology, or implanting some kind of outside control mechanism.

Anthropic has responded that it does not have the ability to modify models post-deployment, and Lin on Thursday said she has not seen any specific “basis to suspect Anthropic would do either of those things.”

The judge added that the Trump administration is effectively arguing that officials have broad powers to label any company that criticizes it as a “subversive” or “enemy of the state,” calling the position “troubling.”

Justice Department lawyers disclosed during the hearing that the Defense Department is winding down its use of Anthropic products and expects to complete the process by the end of September. They objected to Lin’s questions about which agencies have expanded their use of Anthropic’s products, saying it required revealing sensitive national security information.

“The reason I’m asking is because if it is true the [Department of Defense] believes Anthropic to be such a national security threat that they are going to poison an AI model it seems inconsistent for the Department … to then be using Anthropic … and expanding its use of the AI model,” Lin responded.

Trump in February described Anthropic as a woke, radical left firm whose policies jeopardize U.S. troops. The administration has since softened its stance following a meeting with Anthropic CEO Dario Amodei and the company’s release of newer, more powerful models.

The company sued the government in March, alleging the directives and public disparagement by officials violate its free speech and due process rights, among a range of other claims. Anthropic also filed a second lawsuit in the federal appeals court in Washington, D.C., based on the statute that underlies the supply-chain risk designation. That case also remains ongoing.
