Legally speaking if some dumbass throws himself under my tires and I make a split second judgment that slamming into him will be less dangerous and destructive overall than swerving to avoid him am I required to do anything other than floor it to make his death more painless?

Is the truck driver dead?
I can't tell if his cab folded in half which would've folded him like a pancake or if it folded over in one piece keeping the compartment relatively intact.
Also, for any truck drivers on /o/, is this because of a improperly secured load, chinkshit engineering, or just the weight involved making it inevitable?

How about NO securement? I'm not seeing any straps or chains falling away as he's stopping. And before anybody gets all superior feelin' n' shit consider that picrel has to spell out requirements for load securement for a reason.
