that might have been the open reason because they didn't want to claim the car was aerodynamically inadequate compared to its competition because it very much was. if that gasket wasn't there the wing would produce less downforce because half its purpose is to keep air out of the notch and the other half is to balance the center of lift, allowing air under the lower spoiler would definitely reduce its effectiveness as an airfoil, increase drag and reduce downforce.
