If you have a problem with legality, you need a separate hearing to address that issue as the scope of the current hearings are limited to the criminal case. He will have to file an appeal for that, and appeals almost always fail because it is a bunch of judges that try to validate the original judges opinion and only works if there is some kind of procedural mistake.
