The judge then threw the charges out saying that there wasn't enough evidence that he planned to actually act on his fantasies instead of just roleplaying them on the internet. So yes it is first amendment protected free speech, the speech isn't in and of itself a crime, but it can also be used as evidence against you of an actual crime if there is enough other evidence showing that you planned to act out what you described in that speech.
