Marks issued the decision a day after an appeals court reversed her ruling that the method is constitutional.Marks permanently enjoined the state from executing Jeffery Lee by nitrogen. Lee was scheduled to be executed Thursday at an Alabama prison.A spokesman for Alabama Attorney General Steve Marshall said the state is reviewing the decision and considering next steps, including an appeal. The case will likely end up before the Supreme Court, which has previously allowed nitrogen executions to proceed.A spokeswoman for Lee’s legal team said it did not have an immediate comment.“Were Alabama to adopt firing squad as a method of execution, that method would likely be challenged as well. Indeed, there is likely no method — no matter how humane — that would be immune to constitutional challenge. But the Constitution does not guarantee a painless death, and human life cannot be purposefully extinguished without some risk of pain. The Court, the condemned, and the State must all confront that sobering reality,” Marks wrote.Marks noted that the state has two other methods, lethal injection and the electric chair. She said Lee is “not entitled to an injunction barring the State from executing him using one of those methods.”Marks also ruled that the state could switch to a firing squad.“The State can readily obtain rifles, ammunition, and other materials necessary to carry out a firing squad execution. Additionally, the State would be able to modify space at Holman to carry out executions by firing squad. The State is also able to source and train volunteers willing to carry out such an execution,” Marks wrote.

The makeup of the Court does change over time, so I can see someone wanting to make another run at the Court, hoping their ruling will change, but given the current make up of the Supreme Court, there's about a zero percent chance that'll happen. So this is really just petty, judicial harassment to delay an outcome they know is inevitable.

Another one got commuted by the governor earlier in the year.I'm all for executions and nitrogen seemed very promising but it seems that the method still needs a lot of work. For a method that supposedly promised a quick death, the last nitrogen execution took 30 minutes. There's also concerns that the mask (an off the shelf Allegro full face respirator mask) is not effective enough and that there is oxygen leaking into it. It might work better with a full gas chamber like the old days with hydrogen cyanide but you'd need a state willing to experiment.South Carolina brought back the use of the firing squad, Idaho now has it as its primary method, Utah was going to do one until it was called off last year, it's being looked at for federal executions as well. For all the hype about finding new execution methods it seems that people are just going to move to the firing squad. Provided you don't fuck it up, it's lights out in a matter of seconds.
