Here's my thought: Theoretically speaking, if one were independently wealthy, one COULD test the constitutionality of these types of arrests (and ultimately the subsequent judicial sentencing). The lawsuit could be taken all the way to the United States Supreme Court. In my opinion, the government would ultimately lose such a lawsuit, if it was taken seriously by the defendant. Whichever government entity, which would actually attempt charging someone over such petty matters, does not consist of genuinely strategic people to begin with. They would absolutely overstep, putting themselves in legal jeopardy, because they are arrogant and stupid. The true genius needed here is correctly predicting where the "line" is.The Supreme Court has already made decisions regarding this issue, The fat, stupid, poor, lazy incel losers who already got charged over this issue (as I mentioned above) were too fat, stupid, poor, and lazy to actually defend themselves properly (legally speaking). It's winnable. There's risks, but I don't think anything happens without taking risks. Hitler himself went to prison and wrote "Mein Kampf". If someone were to win such a landmark first amendment case at the Supreme Court, their name would become common knowledge, at least among the people who actually matter. That someone would then not only still be wealthy, but they'd be famous too. They could build a political platform based on a personal achievement: a landmark civil rights victory. Thoughts?
