I think a good way to overturn Trump v. Barbara is for a foreign diplomat in the US to sue to make his child a citizen under the theory that he is "subject to the jurisdiction thereof" which according to the court is synonymous with "subject to the laws of".

The court is unlikely to grant citizenship in this case and it will expose how the current ruling is a contradiction in the following way:
Premise 1: Those born in the US and subject to its laws are citizens.
Premise 2: The children of foreign diplomats are not citizens.
Conclusion: The Diplomatic Relations Act of 1978 is a law that is not a law.

This is the worst contradiction since "separate but equal is inherently unequal".

The Naturalization Act of 1795 essentially barred foreigner children from becoming citizens when Wong Kim Ark was decided too. Didn't stop subsequent court's from claiming birthright citizenship existed but nobody talks about the fact that Wong Kim Ark's kid ONLY got citizenship because Ark had been in the USA for the specified time to gain his own citizenship according to the Naturalization Act.

But yes, if your parent used to be a diplomat, but no longer is, and then you are born in the US, you are a US citizen, like fucking almost everyone else born here.

Likewise, if your parent used to be a diplomat, and you naturalize, you are a US citizen, like fucking everyone else that naturalizes.

The parent's professional station doesn't impact their child's birthright citizenship. The law impacts their child's birthright citizenship.

If the law said diplomats and their families didn't get diplomatic immunity, their kids would become citizens at birth. If the law said diplomats get diplomatic immunity, but not their families, their kids would not become citizens at birth.

It is only because the law says the families of diplomats get diplomatic immunity that their kids get citizenship at birth. The citizenship of the child is dependent on the law, not the job of their parent.
