Legally speaking, if she doesn't return the money, she can be charged with "unjust enrichment". She can go to court and argue like a sovereign citizen that she's right and the legal system is wrong, but the judge will still rule that she knew it was a mistake and she unjustly took advantage of it. While she's serving time in prison and has a felony added to her likely already existing criminal record, she can profess her innocence to deaf ears.
