I had a similar issue at a property I bought. Probably, the road isn’t actually a public road. On my parcel, we had a road that was in effect a driveway to my home that people had just been using however they want for a long time. It was a nuisance so I went to court to demonstrate that the road was in fact mine and the people using it had legal right to use it regardless of what they’d been doing or how long. In the case of this guy, this is clearly not a public road because if it was a public road it would have to be maintained by the government and have utilities. The fact that it has no pavement, no plowing, no salting, no lighting, nothing demonstrates that either this isn’t a public road or is technically public but has no basis for being public. In most states, if a public road isn’t maintained by the government it ceases being public. They’re obligated to do it. So if this guy is responsible for all the maintenance and upkeep and it’s on his property and provides access to only his property, it’s indeed his private road one way or another.
