>judge halts sale
I mean... id just ask for a massively reduced price, with all the publicity that house will be a nightmare to sell
>>
>>539302292
A judge has halted the sale of a foreclosed Burlington home that was won during a bid before three people were found dead inside.

Judge Joseph M. Shortall issued an order on Wednesday calling off the sale of the home at 7 Stanwich Lane “pending further developments regarding the remains found in the subject property,” he wrote.

The order comes just days after attorney John C. Lewis III filed a motion to open the judgment on the foreclosure case against the previous owners of the property, Paul and Sally Anne Cash. Lewis represents Edward A. Marchion of Newington, who successfully bid $525,000 when the home was being auctioned, court documents said.

Connecticut State Police have not mentioned Marchion by name, though they said the new buyer discovered the skeletal remains of three people on June 14 upon entering the home. Two of the remains that were found have been identified as Sally Anne Cash, who would be 54 years old, and her son, Brian Cash, who would be 22 years old, state police said.

The Connecticut Office of the Chief Medical Examiner said Friday that the results of their autopsies remain pending further studies. The office also said the third person found in the home has not yet been identified.

In his motion in connection with the foreclosure, Lewis speculated that the third person may be Paul Cash. Lewis noted that investigators are still trying to determine when the three people in the home died.

Lewis went on to say that the foreclosure against the Cash’s may be “defective” depending on several factors, including when Sally Anne Cash died. The foreclosure action is also dependent on whether or not the third person in the home was Paul Cash and, if so, when he would have died.
(1/2)
>>
>>539302292
>>539303293
Unless it can be proven that the homeowners were alive when the home was foreclosed, then the action would be considered defective as the Cash’s heirs, the Probate Court, the Department of Revenue Services and Attorney General “were not made parties to the action,” Lewis argued.

Lewis’ motion, which was granted by Shortall, sought the suspension of the closing date pending the outcome of the state police investigation, which could then be used to determine whether the foreclosure action is “valid or defective.” Lewis said the suspension would also protect the heirs to the Cash’s estate.

According to town records, the home had last been purchased in 2019. A mortgage company filed a civil complaint last August against Paul and Sally Anne Cash to foreclose on the home, court records show. Those proceedings were finalized before a public auction was to take place on June 6.

so two old people and a son 22 years old. the way the world is going i bet the kid thought he would inherit the house parents told him the truth how they literally spent all of "his" money on vacations and stupid shit probably already had something set up for themselves retirement community and the kid would need to just figure it out so he went bang bang bang
>>a family that dies together stays together he thought
>>
>>539302034
Shouldn't that have been found during the home inspection?
>>
>>539302598
It's a foreclosure auction, you don't get inspections on those most of the time. The funny and sad part is that the mortgage company files suit last year and never even thought to call in a welfare check in the intervening time. Now the foreclosure and sale will probably be voided and they'll have wasted a years worth of legal fees to likely get less back than they would have.

the house foreclosure, may be a different market. so basically the entire family died, the bills weren't paid, and the state or lenders repossessed the house and put it up for sale without asking questions. bureaucratic retardation in its purest form.

>>
>>539303451
That's still a consumer issue for being stupid enough to buy something uninformed. I'm sure they don't care because they're only looking at the short term profit, but that's part of the reason houses are more expensive than what they should be. Who knows what kind of repairs could've been hiding with the skeletons in the closet.
>>
>>539303758
>three bodies were found, including Sally Anne and her kid
some dude got away with murder
or they died from natural causes
>>
>>539302034

If the 22 year old was a NEET, maybe no one missed him but the other two are baffling. Maybe she was a housewife and he was retired? And they didn't have any friends who would notice they stopped hanging out? Or the friends are accustomed to modern trends in people ghosting without explanation? No extended family? It's possible but the whole thing seems rather odd.

>>
>>539303451
Eeehhhhh, if someone's a deadbeat on a mortgage they might never talk to you even if they're still alive. For them it would've looked the same as if it was just someone that didn't have the money and wasn't going to pick up the phone or answer a letter.

But you would think SOMEONE would've gone to look at the house after the notice to evict. Like, would they not have sent a cop at some point just to make sure the people had left?
>>
>>539304231
They're not uninformed, you get discounts on auction houses because they are sight unseen. The only people who buy properties at auction are cash buyers that buy lots of them. Occassionally finding something catastrophic is part of the business and you can write off any losses. This wasn't some naive person buying their family home.
>>
>>539307646
Usually at auction you're just paying enough to pay back whatever mortgage company foreclosed on it, they don't care about anything once the balance is covered. And at 54 years of age, bought that house 7 years ago, they probably had good equity on it.
>>
>>539302034
They got squatters rights.
>>
>>539302034

>>

>>
>>539302332
dude thats like so kewl
>>
>>539302034
So basically the entire family died and instead of checking it out even once, they simply foreclosed on the mortgage, sold it at auction and then finally found them in a state of being dead. Kek, that's wild .
>>
I inherited my house from my parents and when they died they wanted to be buried in the garden

This, considering all the bureaucracy and nonsense that applies here, was simple. I did it with the help of an undertaker and a stonemason that I know. My sister and my brother and his wife sadfaced because even though it was what they wanted, it might affect the value of the house. Which is entirely owned by me and I won’t be selling

Three skeletons do not need a house that big anyway.
>>
>>539307633
A lot of shit can be on autopay, and I have no idea what the parents did for money, or how much they had saved up.
I mean, maybe dad had the house on autopay, from an account dedicated to paying the mortgage only, so it never had more than two or three payments in it at a time, and it ran out after their death, causing all of this to finally start. Meanwhile, the family cell phones were on autopay for a while after their deaths, months, who knows. So all calls go to voice mail.
Still, for no human to actually go inside until after the auction?
I mean, the new buyer discovered them immediately. The smell had to be horrendous. Dead for what, a year at least? It's not like they were walled up and quicklimed in the basement.

It used to be standard practice to keep your dead family members bodies in or under your home so they as your ancestors could protect you from evil spirits. It also had the practical effect of legitimizing your families claim to the property in a time before deeds and registrars "this property belongs to me, my pappies skeleton is here so this belongs to my family, also he will haunt you if you try to take it"

Woah dude

What would happen if someone found a fairly secluded house owned and occupied by one person, broke in through the back and waited inside, coerced them into giving up all documents and passwords, made them speak about their entire life, recorded that, killed them; and then used their life story to train an AI model to deepfake their voice so they could call their employer and quit due to sudden mental health crisis, and their friends and relatives to tell them they are okay but need time away from them to recover, and then just lived there as that person for long enough to slowly drain their banks accounts into a "business venture" that actually dumps it all into XMR, before setting their skeleton on the kitchen floor and quietly leaving after sterilizing the house?

Fucking sick people out there, dude. Never know who you can trust. Often best to trust no one, and live alone in a secluded area.

The defect is that the home inspector is trespassing on the property of whoever is determined to own the home after probate. The state has to determine who was supposed to receive the home to begin with and then sort out the fact that they sold that person's home without their permission.
