Yes, using a chinese phone that uses their chinese GPS system counts as using chinese GPS, not what is typically referred to as GPS (note the capital letters). So yes, even in your example if they were using a retail chinese phone with a chinese sim and access to the chinese GPS (BeiDou), it would not be a standard GPS. Not sure why you're trying to paint that as a gotcha
