Well if the police want to publish the unredacted Epstein files, we can talk. Before that? Fuck off.
>>
I don't know which is worse in terms of time served, but I know that if they plant CSAM on you, no jury is going to give you the benefit of the doubt, you run a real risk of being killed in prison, and when you get out you will be a sex offender for the rest of your life. Even if wiping the phone is a crime, it creates a situation where logically they can't plant any evidence, given that all parties acknowledge you intentionally wiped the phone. The whole point is to punish you if they don't find anything personally incriminating, but ultimately what they want is to get all of the contacts, call logs, and text messages off of your phone to go after other people. It's like your snitching, but they don't even have to help you out, they get a free conviction for a horrible crime that nobody would dare seriously question. That's how cynical they are. They accuse people of one of the worst things you can do, simply because they know it won't be questioned. Meanwhile half of the government is in the Epstein files and they do nothing.

>>539793621
Case in point. It's the new no-no word. Nazi, communist, pedophile, terrorist. Ideological positions that can be proven through accusations of thoughts and opinions, not just actions. They can't just call someone a murderer out of thin air, their has to be proof. But they can call you a terrorist, and simply being one (in intention, in thought, in spirit) is a crime. The crime can be supposedly thinking about planning to do some unnamed thing at some point. It's like calling someone a witch in 1650. And if you question the accusation? You're a terrorist sympathizer. You're practically a terrorist yourself. Nobody of pure heart and mind would dare question an accusation like that!

If your suggestion is that the government can't prosecute you for having illegal material on your phone because the phone belongs to you or whatever confused shit you're talking about then yes, it is exactly the same.

But that has nothing to do with the 4th amendment anyway which has absolutely nothing to do with the shit you're talking about. The 4th amendment protects against "unreasonable searches and seizures". It is completely legal and common procedure to search the belongings of travelers returning from abroad, something that every traveler is aware will happen.

>He had no legal obligation to hand over his password
He actually did and plenty of people have gotten jail time for refusing to give up their passwords. It's no different than trying to keep police from searching your house or from destroying evidence to protect it from a search, something that is absolutely a crime.

Your phone doesn't exist in some magical realm apart from reality. If a judge issues a warrant for law enforcement to search your phone and you interfere then you've committed a crime and you will absolutely be prosecuted for it, as many people already have.
>>
>>539795159

Also, it's interesting that the people crying about the constitution have the least understanding of it. The constitution does not protect you against searches, it protects you against "unreasonable" searches. Every legal authority on Earth would agree that it's reasonable to search someone entering the country hence the constitution offers you no protection here.

Man, modern conservatives sure are submissive and breedable lately.
>>
>>539795571
I don't know what youtube channel you're getting your legal advice from but being an American citizen doesn't give you some magic right to bypass customs.
>>
>>539795654
CBP can
>Question you about your identity and travel as well as what you are bringing in
>Inspect your luggage, vehicle, and personal belongings
>Do a basic search of Electronic devices, the constitutional rules of which are still in litigation and not clearly defined
>Detain you if they need to verify your identity or investigate customs issues
>Sieze prohibited or undelcared items
CBP cannot
>Deny a US Citizen entry
>Arrest you without legal authority
>Use excessive force or discriminate
>Search everywhere without limits
CBP cannot refuse entry because you decline to unlock your phone. They might detain you longer, question you further or retain the device. Refusing to give a password is NOT A CRIME. A US Citizen has the right to enter the United States and remain silent if they so desire.
>>
I can tell you for a fact, that you don't need a phone. At all. No, really, I promise. Not even a land line. And you don't need to carry any gadgets with you. Just a wallet and your keys. Pocket knife, maybe a pack of cards. You can even ditch those!

Soon you'll learn.
>>

>>
>>539795863
The problem is people are okay with handing over DATA as if it's something that can cause real bodily harm or injury. Doing a cursory x-ray scan if electronic devices to ensure you didn't pack your phone with plastic explosives is acceptable to 99% of people I imagine. Access to message history, photos, contacts, app data, e-mail is beyond the scope acceptable withing CPB jurisdiction logically. What risk is being mitigated searching citizenry without a warrant? If it's a domestic terrorism concern the body that should handle it is the FBI and yes, that means get a fucking warrant. It's because of bootlickers who trade privacy and individual rights for perceived safety that we run into tyrannical over reach like this.
>>
I hope all the foreign government-owned "press" makes a big deal AND we throw the book at this guy just to discourage foreigners from coming lol.
>>
>>539795863
Yeah, again, I don't know what youtube channel is feeding you this sovereign citizen shit but customs has the right to search you when you enter the country and if you interfere with that search then you are guilty of obstruction, which is what the guy in OP was charged with.

I don't know what to tell you, man. No amount of seething is going to change reality and the reality is that there are a myriad of laws in place to prevent people bringing illegal material into the country and the contents of your phone are not immune to those laws. Obviously the guy in OP had illegal shit on his phone, no one is going to wipe their phone for fun, so you're basically here simping for a guy who wanted to bring a phone full of child porn into the country.

Refusing to unlock your phone when presented with a lawful search is a crime and people have been jailed over this many times.
>"If they arrest you for anything -- whether it’s drugs, guns, you name it -- and an electronic device is nearby, they can get a search warrant and search it. And if you don't provide that information to search it, to unlock, because you want to keep the information private, we'll put you in jail"
I realize you've been fed a bunch of internet propaganda but electronics don't exist outside of existing legal framework. I'm gonna say it one last time so listen close:

Refusing to show them what you have in your phone is no different than refusing to show them what you have in your suitcase and yes, you can

>>
>>539796212
The key difference is an articulable reason is given to a judge and the judge rubber stamps the warrant vs just searching citizens without one. If a crime is commited the phone can be collected for evidence but the data won't be harvested without consent or a warrant because it would poison the evidence for the case. Ill-begotten evidence gets thrown out every day and LEOs know this. In this case charging obstruction when it was a "consentual search" and not a warranted one is silly? Obstructing what? An investigation? What were you investigating? Did you have an articulable suspicion there was a crime? Okay, so why didn't you take custody of the phone and get a warrant? It's not that crazy of a concept.

Of course. The reality is that these people know it's a crime to wipe their phone to avoid a search and the only reason they do it is because they know that the punishment for wiping their phone will be less severe than they would be given if law enforcement saw what was on their phones.

Tells you a lot about all the niggers in this thread screaming that they didnu nuffin and the cops aren't allowed to search their electronic devices. Like I guarantee guys like >>539795863 who have been in this thread for hours screaming that it's illegal for anyone to search their phone have a bunch of CP on it.

>>539796966
You'd better hope you can convince them because that's obviously what someone who doesn't want to give up the password would say. A better option would be to not end up in a situation where law enforcement thinks you have illegal shit hidden in your safe or phone. They're not checking the phones of every person who crosses the border so obviously they had some sort of reasonable suspicion of the guy in OP.

In Cryptonomicon, by Neal Stephenson, there is a bit where the feds raid a bunch of anti-establishment computer nerds and steal all of their hardware because they have been helping the protagonist with the conspiracy plot he is embroiled in.
He's freaking out because he thinks he is fucked. The nerds are just siting in the corner smugly watching the cops take all of their hard drives. When he asks them how they can be so calm about this, their answer is "Because I turned on the light switch in the back closet".
"How does that help?"
"That switch turns on the magnetic degaussers on either side of the doorframe. Every hard drive they walk out the front door with is getting wiped in their hands."

Summary:

Federal prosecutors in Atlanta have charged U.S. citizen Samuel Tunick with obstruction for providing customs officers a duress passcode that triggered GrapheneOS software to erase the data on his phone. Tunick was stopped and interrogated at Hartsfield-Jackson Atlanta International Airport on January 24 while returning from the Dominican Republic; officers seized the device before allowing him to enter the country. The case is among the first known federal prosecutions for using a wipe feature designed to destroy evidence when a specific secondary code is entered instead of the normal unlock passcode. His lawyers contend the seizure was unlawful and that he was targeted over his activism against Atlanta’s planned “Cop City” police training facility.

The underlying statute makes it a felony to destroy evidence in order to impair the government’s lawful authority to seize it, carrying up to five years in prison. Courts treat digital data as property, so a software wipe is legally equivalent to destroying physical evidence; the government argues the phone was merely a container and that entering the duress code was the act that destroyed the data the agents were entitled to examine. Border-search authority is central to the dispute: Customs claims the power to search devices without a warrant, while Tunick’s defense maintains he was unlawfully detained, never advised of his rights, and denied counsel. Legal experts note that intentionally supplying a wipe code during active questioning falls squarely under the statute, though the government has declined to detail the underlying investigation.

I truly believe Norh Koreans are good well meant people. That value freedom over anything. But truth and integrity over freedom of obstructing the righteous path.

You can see it in their eyes, their smile.
I don't undestand the title of this thread.
They want to do right. Live according to justice. Not justice by the law, but the law as the will of God. The proper way. That what is right. And that is to be respected. They truly are trying. They are better people, I suppose. Honesty comes a long way.

I don't know why all these non-Americans are suddenly experts on the American legal system.

You don't need to be under arrest to be searched when you go through customs. Part of the customs process is that you consent to all searches before you enter. Customs agents have the right, legally, to search every inch of your body and your belongings before they let you enter the country. They do not need a warrant for this, you do not need to be under any kind of arrest or suspicion. Every person attempting to enter the country is subject to this.

>It's the same thing as him wiping his phone before boarding the plane.
This is like saying throwing a bag of drugs out of the window of your car while you're sitting in your driveway is the same as doing it when a police car is behind you attempting to pull you over. Context matters and the context here is that they requested to search his phone and he obstructed them, which is why he is being charged with obstruction.

Are you telling me that if I tried to bring a suitcase full of heroin into Italy then your customs agents wouldn't do anything to stop me?

Are you saying a search is a search is a search? Whether you're detained or arrested or at an airport? Is it the same thing as questioning, is being questioned when you're walking down the street the same as when you're detained, the same as when you're under arrest, the same as when you've been informed of your Miranda rights?
Do tell Mr Expert.
>Are you telling me that if I tried to bring a suitcase full of heroin into Italy then your customs agents wouldn't do anything to stop me?
You wouldn't be put in jail because someone thought you may have had heroin in your suitcase that no longer is there and there's no way to prove it was, no.

>Bring a burner phone
Another thing you can do if you plan to take a trip roughly around the time you need a new phone is to get that new phone, set it up to be your main phone after you get back from your trip, delete a bunch of apps from your old phone, log out from anything that might be incriminating, clear your web history and any cookies you might be worried about, but keep just enough on your phone to make it look like it's still your main phone.
After you're done deleting a bunch of apps, data and whatever else, fill your phone back up with a bunch of useless junk (movies, music, etc) and delete it right away. That way if anyone tries to dig into your phone to find traces of anything you deleted recently, they'll just see bits of that useless junk.

There's nothing against the law with deleting data during a search. Politicians delete data during a search all the time. Hillary Clinton infamously locked a door in the White House while she shredded documents and Ken Starr sat there outside the door like a kek waiting for her to finish. and then Hillary would do it again years later with those computer servers of hers lol dabbed on 'em a second time

In Italy, I saw on a major TV station that when you arrive in the UK, they connect your phone to a PC via a cable and can see everything, even your chats, even deleted ones on encrypted chats (Signal?). I looked for more information but found nothing. Even though I have nothing to hide, if I leave my country, I'll either buy a cheap, blank smartphone just for abroad, or use an old boomer phone, but that way I'll give up email and WhatsApp.

Yes. The article actually goes a bit more in depth about how western governments are thinking of trying to take action against GrapheneOS. They mention that France had a non-public program about it, and in northern Spain if the cops take your phone and see GrapheneOS they put you on a list with drug dealers to search you every time you go through a check point.

Legit retarded or 0/10 bait

Being so that a passphrase is information of the mind, being compelled to give it up is constitutionally illegal because it violates the fifth amendment in regards to self-incrimination. However if you use a fingerprint or face unlock, you can be compelled to give that up because it's information of the body, just like how a judge can sign a warrant to have a blood sample obtained after a DUI-suspect crash.

You are a communist. The UK is almost worse than North Korea these days, it's a risk to even state this fact because it could be "offensive" to the state.

im unfamiliar with how customs actually works in regards to our unlawful search and seizure rights.
i know with cops, if you lock your phone, they literally need a warrant specifically to go into your phone. should be the same with customs, in theory, but then they also deal mostly with non-citizens. so idk if theyre actually given extended powers in this regard.
at any rate, the guys a US citizen. 4th is specifically protection from exactly this. so without a larger investigation (ie NOT just a basic customs check), he can probably just take this to court and win

The elephant in the room here is that a left wing activist is absolutely likely to be a pedophile even though it's not really what they wanted to search him for. Lock him up before he rapes again.
