Why the potential penalty is so low

When the Bharatiya Nyaya Sanhita (BNS) replaced the IPC on 1 July 2024, Section 377 was completely omitted with no equivalent provision for sexual acts with animals. Bestiality is no longer a specific criminal offence under India’s primary penal code.

PCA Act 1960, Section 11(1)(a) (treating an animal so as to cause unnecessary pain or suffering): first offence — fine of ₹10–50 (roughly 12–60 US cents). Subsequent offence within 3 years — fine ₹25–100 or up to 3 months’ imprisonment or both. These figures have not been meaningfully updated since 1960.
BNS Section 325 (mischief by killing, poisoning, maiming, or rendering useless any animal): up to 5 years’ imprisonment and/or fine. This requires proving “mischief” with intent to cause wrongful loss/damage and actual maiming/killing/rendering useless. Pure sexual abuse without clear permanent injury often does not fit cleanly, so it is frequently not applied or is weakly applied.
