I was awarded 87k in underpayment after taking my employer to court. This lead to an automatic audit of the companies books and they discovered that one employee was being underpaid for 22 years. Over half a million dollars in underpayment. Another was 10 years of underpayment. However in Australia a worker can only ever claim back 6 years of underpayment, and they have to do the court process themselves. So it doesn't matter that the regulator discovered the underpayment and confirmed it each employee has to do the work themselves and take it to court. The gov changed the law on the 1st of January 2025 and made it so wage theft can be punished with a max 10 year prison sentence. I am pushing to get the guy thrown in prison. I have been battling this for an entire year.

Because I have been going through this I have been talking about it openly with friends and family and the tragedy is that everyone has a story about it. Even my doctor told me outright that he gets scammed for his overtime as an ER doctor. Every part of Australia is festering with the exploitation of workers. And our unions got fucked hard. Imagine how bad it would have been before the internet.

And since you don't know much about businesses, in most jurisdictions when a company goes bust there is a order to pay back liabilities. Usually state taxes are first to be paid, then secured loans and only after employee unpaid wages. So yes, many times workers lose personal property when a company they work for goes bust
