Why is attempted murder a lesser sentence than murder? You tried to murder, the intent was to kill. You just failed, but in intent you are the same as a murderer and should be treated the same.

My argument is that the intent matters. For example if someone shoots at a person but fails to kill, they are the same morally as someone who shot and killed. They both had the same intent, just that one missed.

With actual murder a person diedIt is counterintuitive that a bad person would get less harsh punishment just for being unsuccessful but it's not the only factor that goes into punishments. The victim and victim's family lost more if murder attempt was successful and this payback element is part of legal system

Also clearly in context I am meaning the intent in the act, not just thinking about it. Attemped murder is an act with the intent to kill. The action with intent to kill is the same whether you succeed or fail.
