I'm close to a free speech absolutist, but aside from whether pornographic images in general are speech, realistic cp images can muddy the water for enforcement. That is, real images can be claimed to be AI and vice versa. Best to make it all illegal. Someone generating their own local images and not sharing them would be able to get away with it since there would be no hook to start the investigation, kind of like sodomy laws back when fags actually did do things in the privacy of their own bedroom. Interesting angle. This is more or less the same question as "is AI generated art considered art?" (No I am not implying that AI-generated CSAM is art, I'm stepping back and examining the bigger picture, no pun intended)

There exists a gradient of automation with the simplest stuff (e.g. fill bucket in paint) on one end and generative AI on the other. Somewhere along that gradient you go from being sufficiently human driven enough to define the result as being a trademarkable, copyrightable, protected-speech work to (arguably) being something that lacks sufficient human input to be classified that way.

Where exactly you draw the line on that gradient is the hard part, and the annoying thing is that it'll probably end up getting drawn in several places in different contexts (like art, or literature, or computer code, or even the current thread) that will make it even more confusing to argue about how much AI something can be made from before it falls into one category or the other.

There is a real album which exists entitled "Virgin Killer" produced by the band the Scorpions which features album art which has already been established by multiple international committees as child pornography.
A user clicks a YouTube video
Without any user interaction, the algorithm autoplay serves up a song featured on the album - it's a harmless feature - it's just queing rock songs from popular bands around a specific era - but you see the problem here as the album art is now displayed to the user
Who is at fault here? The user? The algorithm? The hosting service?

A major airline company literally tried to argue they were not legally responsible for the output of their chatbot assistant, because the chatbot was it's own entity and could therefore be actioned directly as an employee of the company, not the company itself.

In that scenario, the algorithm and thus the company would technically be distributing it, right? So if we're talking about an online AI generation site, they would be the ones distributing illegal content to the person that prompted it(including breaking copyright laws) . I'm not sure if the data center's computer that prompted it would be responsible or the guy that entered the words on the website though, that'd be interesting to see a judge rule on since the corporations are generating, hosting, and distributing that content.

AI is going to end up having a lot of legislation about how it can be used in the future, I'm sure. But first they need to build up the networks and beat China in the AI arms race so I can't see them cracking down on anything until that happens. They don't want red tape right now.

So technically it *is* the algorithm, but it also technically can't be held liable for damages - one cannot sue a horse directly, it has no agency in this way
The solution is simple. Algorithms and AI are livestock. Unless of course, AI is conscious, then that's a problem entirely

Doubtful, AI regulation is very challenging - what we regulate our competitors won't and they'll win by default by doing so - it's why AI has been so aggressively unregulated for so long, hostiles like China and Iran will not play by the rules and have no problems using AI to exterminate problem citizens and house people in cages like termites.
