Funny story actually... it used to be that if you claimed insanity you were relinquishing your rights to the state and would then become a ward of the state in a mental asylum.

But republicans in the 90's dismantled the entire function of a state run asylum in favor of privatization. Corps then decided there was no benefit to their shareholders having two separate facilities and combined mental asylums with the prisons. Now that we have our prisons stuffed to the gils with potheads, most crazy people are put on the streets since being crazy isnt a crime that shareholders like to profit off of because it looks bad.

No one "in society" gives a fuck about rehabilitating these monsters. They want them gone.

There are two theories of how punishment for a crime works: rehabilitation and deterrence.

Rehabilitation seeks to reform the criminal so they can be a functioning member of society again. In the case of insanity, the obvious answer to this problem is to treat the mental illness to blame for their actions. Locking them up in prison doesn't accomplish anything, though depending on the nature of their mental illness they might still end up in an asylum.

Deterrence seeks to use the punished criminal as an example to other criminals, to warn them off doing similar actions. This is pointless in the case of insanity, because you cannot deter the mentally ill with such threats. The rational cause and effect nature of "do crime, be punished" has no impact on an irrational mind that operates in delusional reality.

So regardless of which theory of punishment you feel is correct, it doesn't make sense to imprison the mentally ill like they were some other kind of criminal. Locking them up and throwing away the key won't get you anything.

Additionally, by adopting an affirmative defense such as an insanity plea, you were also considered to be pleading guilty, and had to essentially make an affirmative case on the insanity for why your SENTENCING should not be the default sentence.
Such a plea used to be a flat out forfeit.

You're forgetting the third reason and that's removal, removing the people likely to harm innocents from society. If a person is not rational, cannot reason, then obviously neither rehab nor deterrence works, at that point they are similar to a wild animal like a cougar who's killing people. What do we do with wild animals who kill people? We remove them from society. Ultimately the lives of the innocent take priority of the guilty, therefore you need to do a cost benefit analysis when choosing among the three options. Is it worth trying to rehab someone, are they likely to commit the crime again? The criminal justice system in the west has been moving in a trajectory away from trials meant to determine guilt or innocence in order to levy the correct punishment and more in a trial asking why the crime was committed in order to correct the criminal.
The state's efforts at crime prevention no longer seeks to corporally punish or humiliate the perpetrator but to correct him so he doesn't reoffend or at least to keep him away from the public so that he can't.
This is why we have joint suspended rehabilitation, crime diversion programs, supervision, and mandatory instutionalization in a psyche ward instead of scaffolds, gallows, pillories, guillotines, racks, and other devices meant to humiliate and bring pain on criminals.
The justice system of olde was only concerned with who was responsible. Today's concerns itself with why the guilty party did it.

Look into the history of 'Not guilty by reason of Insanity'. He was a northern Democrat in pre civil war times, politically connected.
