A real estate agent from Tuscon got into a spat with a flight attendant midflight and was duct taped and ziptied to his seat after calling the flight attendant a nigger faggot.

Hey guys, I thought this was America? Making fun of spooks and assmunchers is every man's godgiven right. This guy should sue the airpine for battery and kidnapping.

After i left LA in 2024 i got shit faced on the plane and left the bathroom door unlocked so a dude opened it on me while i was sitting on the plane in first class. Pants around my ankles i was like "Bro you gotta knock" "hes like why didn't you lock it!" and me and him awkwardly argued about it for 5 minutes while i sat down i was also in first class. The stewardess just kept me awake for the remainder of the flight.

>Kek What a bunch of fag's

And i just came back from 637 wall street in Skid Row in LA had a hard time dealing with a dead body i saw being wheeled outa the front of the place. but honestly i probably should have locked the door the faces on those poor people were priceless tho XD

Never again will i drink on a flight.

Unruly behavior is taken seriously by airlines. There are strict federal laws about it, in America and Europe and elsewhere. Whenever something like this happens, the passenger always gets jail time and a massive fine. They had to divert the plane and do an emergency landing. That is not cheap. And guess who gets the bill.

But yes, I'm sure you virgin neets who have never been on a plane are the experts here.

This kind of a thing has happened hundreds of times in the last decades. How would this be a precedent? If despite your law degree you can't find a single instance where a detained passenger sued and won a big compensation, then why do you think somehow this case is different?

Your questions are all irrelevant by the way. Maybe one day you will step on a plane and see how things work there.
>>
>>542151261
>when is it okay for a fully trained police officer or medical professional to duct tape your head to a chair?
at any time when it is reasonably necessary. emergency is a defence to many criminal charges. as a nurse i can apply physical restraints to people at will if i deem it's appropriate. the restraints then have to be reviewed and authorised, obviously, but if you're being a dumbfuck i absolutely can restrain you.

>was the flight attendant a fully trained police officer or medical professional?
no

>under what authority did they duct tape his head to a chair?
https://www.fog.it/convenzioni-en/inglese/tokyo-1963.htm

The aircraft commander may, when he has reasonable grounds to believe that a person has committed, or is about to commit, on board the aircraft, an offence or act contemplated in Article 1, paragraph 1, impose upon such person reasonable measures including restraint which are necessary:
to protect the safety of the aircraft, or of persons or property therein; or
to maintain good order and discipline on board; or
to enable him to deliver such person to competent authorities or to disembark him in accordance with the provisions of this Chapter.
The aircraft commander may require or authorize the assistance of other crew members and may request or authorize, but not require, the assistance of passengers to restrain any person whom he is entitled to restrain. Any crew member or passenger may also take reasonable preventive measures without such authorization when he has reasonable grounds to believe that such action is immediately necessary to protect the safety of the aircraft, or of persons or property therein.

being a nurse in australia is very different from being a flight attendant in america.
in america, we have something called "unlawful detention" and "deprivation of rights under color of law".
we even have a mechanism for suing the police if they don't do everything exactly right (it pierces qualified immunity): 42USC1983
literally nothing you posted would give someone the right to duct tape a passenger's head to a chair for saying mean words.

By the way a 1983 claim can only be made against govt officials. Unless it was an air marshal slapping you around you're not getting anywhere with that. why are you asking questions that you already know the answer to?

your position is that he shouldn't have been restrained so regardless of the evidence you will deny that anyone had the authority to restrain him.

this is wrong. the aircraft commander had the authority to restrain him. this is why way things have been since 1963 and this is not the first time this has happened since 1963. nothing is going to change and nobody cares.

simply accept that the world is not the way that you want it to be and go on with your life instead of having this stupid doomed argument.

>your position is that he shouldn't have been restrained so regardless of the evidence you will deny that anyone had the authority to restrain him.
that is a strawman of my position.
my position is that it's 2026. 2001 was 25 years ago. a law that was passed giving air crews unconstitutional authority finally has a case that puts on full display exactly that because it comes with a ridiculous picture of a man with his head duct taped to a chair.
we don't treat murderers that way.
we don't treat rapists that way.
because it would violate their civil rights.
that picture so clearly depicts a man's civil rights being violated that it fills me with hope that we may finally be rid of this retarded law.
that is my position.
the aircraft commander had authority that was unconsitutionally given to him and the flight crew used it to abuse and violate a man's civil rights.
>>
>>542156343
If you think it's unconstitutional why won't you step up and fight it in court? Do it while you are representing that guy in court and getting him his massive settlement.

>blah blah blah

>>542154338
Apparently there is/are (a) witness statement(s) that he put his hands around the neck of a woman near him. This is contradicted by the actual assailants which said they immediately restrained him when he insulted people near him. I don't know what to believe, it's possible the cause/effect are being confused by witnesses.
>>
>>542155589
>the aircraft commander had the authority to restrain him
The aircraft commander never asked for him to be restrained this was purely the decision of passengers near him. If he was "hands-on" with another passenger they're completely justified. If he was merely insulting people around him there's a chance they aren't justified. So long as he was on a plane the courts will treat him as the primary aggressor and give him disorderly conduct. The chances are that he was drunk or high and was combative for no reason, it's also possible the other passengers both instigated the verbal confrontation then put hands-on.

This is a temporal issue. Was he fighting and biting as they were trying to restrain him or before? Given niggers and faggots thin skins most like he said the bad word and they attacked him.
>hes lucky the plane officer didnt taze him
This is a huge piece of evidence pointing towards his innocence. The officer RIGHT there didnt think he was fighting or attacking anyone.

>>542150729
>>542161935
Again, all that goes back to assaults. There has to be a physical aspect to it. Saying the words “nigger faggot” does NOT constitute an assault or an eminent assault. And given the officer on the Plane refused to taze him or do anything, its pretty clear there was no physical altercation initiated by the man. Without that, the airlines actions are a clear violation of the customers rights and he’ll win a lot of money.

Notice how every story buries the physical fight side? Almost certainly because the “nigger faggot” started it.
>>
>>542163232
Words arent violence. And if you want to detain the violent ones you should be detaining the flight attendant who almost certainly started punching first. (Which is why the news articles minimize the altercation)

i hate having to explain my position over and over and then you replying in a retarded way like
>oh, yeah?!?
>if you can identify that it's unconstitutinal
>then why don't you quit your job, leave your family, go earn a law degree, and stand up for this guy?!
"congress shall make no law... abridging freedom of speech..."
there are time, place, and manner restrictions that the supreme court have dreamed up, but none of those restrictions empower an airline employee to duct tape a man's head to a chair.
none of them.
i wouldn't expect a foreigner to understand, but i don't have to have a law degree to know that any law that empowers someone to abridge the freedom of speech to such an extent as to duct tape them to a chair is unconstitutional.
our constitution was intentionally written so that everyone living under it could understand it.
there are so many ways he could fight this:
1) they duct taped him to a chair and took unflattering pictures which is arguably cruel and unusual
2) they duct taped him to a chair over his speech which they absolutely do not have the power to do--there is no law anywhere that empowers an airline attendant to duct tape a man to a chair. the closest thing they have is the ability to deploy "plastic handcuffs", and there is no provision for improvisation at all.
3) probably more, but i'm not interested in explaining as you aren't going to have a good faith discussion anyway.
enjoy not being american, where i guess you're okay with being restrained over "hate speech".

>>542163729
>Again, all that goes back to assaults. There has to be a physical aspect to it. Saying the words “nigger faggot” does NOT constitute an assault or an eminent assault
I imagine the argument would be that using slurs like nigger and faggot (or any sufficiently loud and belligerent language) qualify as "intimidation". Which would probably justify the initial action by the crew to pacify him. Subsequently, they'd use his fighting back and trying to bite as grounds for the restraint.

>Notice how every story buries the physical fight side? Almost certainly because the “nigger faggot” started it.
I'd agree here. The airline stands to benefit by focusing on how unsympathetic the guy is for saying no-no words and having no-no thoughts about minorities.

>you dont get detained and duck taped for saying nigger
Are you blind, deaf and dumb? People are literally being murdered for saying nigger. Calling a gay black flight attendant a “nigger faggot” almost certainly resulted in the pavement ape losing control and throwing punches at the man in the seat. At that point the mans actions are self defense.

The proof is the officer on the plane saw no need to taze the guy or get involved. The officer RIGHT there thought he wasnt being violent. Your second guessing from 3000miles away is not worth the paper its printed on.

>Again, all that goes back to assaults. There has to be a physical aspect to it.
No, there doesn't. The airplane commander has the authority to restrain passengers to maintain good order and discipline.
>>
>>542166871
>the airline commander can detain anyone at anytime
Sure, but the airline is liable for any overreactions by the airline commander. The commander could duck tape every passenger and ensure an orderly flight;however, the airline would be slapped with hundreds of lawsuits and lose billions. The commander would be fired and sued for everything he had by the airline.

The issue here is if the detainment was justified. And that justification requires a physical component. Without it this was kidnapping by the aircrew and airline. The laws you posted literally say as much.

So it all comes down to did this guy attack? Or was he attacked? And since the officer on board didnt taze him or anything the evidence we have points strongly to the airline being in the wrong.
>>
>>542156762
I read up on it after I made that post. You are correct. There's no proof either or for the actual timeline of the assaults. Still, this is pretty funny to me. When they were wrapping him up, he fought to his very last and when his body and limbs were completely tied up, he started snapping at and biting them until they taped his head. kek
That's some Cú Chulainn last stand type of shit
>>
>>542167597
>The issue here is if the detainment was justified. And that justification requires a physical component.
No, it doesn't. If a passenger is drunk and aggressive and provoking fights, you do not have to wait for a fight to actually break out to confront him and ask him to stop. And if he refuses to stop, you can make him. The use of force to enforce compliance with directions is completely unbounded because for directions to have any meaning they must be enforced. The force will escalate until compliance is secured.

the last place anyone should chimp out is on a plane or in an airport. The are so many federal laws surrounding airports and passenger airlines that a simple low level chimpout could see you jailed without trial for a long time if the authorities wished it. You could literally be disappeared for years without even a court date especially after 9/11.
