In most parts of the world, the onus is on the defence to prove without a reasonable doubt that the defendant was of unsound mind and unable to differentiate right from wrong. I don't understand this entire "insane until proven sane" concept because generally, just like how the innocent far outnumber the guilty, the sane far outnumber the insane.

This fucking myth refuses to die that someone who is going to the mental hospital is going to have an easier time than jail.

Let's say you do something like murder your children, admit it and go to jail. They will place you in isolation, because like child rapists people in the jail will want to kill you, mess with you, etc. But even in what is essentially like solitary confinement, you can still read or write letters. You will get your 1 hour a day where you can go to the yard and exercise or see prisoners.

In a mental hospital, if you're in there for just casually killing your own children you will be chemically castrated with drugs, spending a lot of your time in a zombie like state. You won't know what the fuck is happening, you will be drooling from your mouth. You get the padded cell. You don't get to just "go out for a walk" and socialise. Your mind is chemically fucked to where you can't even do certain things.

The myth that the hospital is somehow better exists because of popular fiction, where the accused is going to pretend to be crazy to get a "not guilty" by reason of insanity and thinks the hospital will be like a hotel.

Note the 14 month old, 3rd child, it's very common for women to get pregnant again to try to keep a man in the marriage. To force him to spend more time with her and care for her (for the sake of the baby). When that doesn't work the way they want, women usually try other strategies. An NGRI (not guilty by reason of insanity) verdict means there's no mens rea, and the acquittee is sent to a psych hospital. There, they are regularly evaluated. If they are deemed no longer insane, they are quite literally sent home. This can happen in as early as a couple of months. They are functionally free and only need to have "supervision", which translates to psych visits every couple of months.

GBMI (Guilty but Mentally Ill) is completely different. You are falsely arguing for GBMI when you assert that she'll spend her life in a psych ward or a prison ward.

But there should be a finding of guilt that leads to a sentencing. Too often we forget about the victims of crime and how important a sense of justice is for both the victims and society at large.
Even if someone becomes temporarily psychotic due to a prescribed medication they take one time and they end up killing someone they should still be locked up for 20 years. There is no sense of justice in a society where the people around you, who can interact with you and can hurt you, can potentially exist in a state of criminal unaccountability whereby their actions towards you can never be punished in a retributive manner.
