DHS/USCIS proposed a rule (Docket USCIS-2026-0364) to eliminate the discretionary 60-day grace period for H-1B, L-1, O-1, E, and TN workers. Right now, when Rajesh loses his job, he, Priha, and his 15 family members get up to 60 extra days to stay in status and job-hunt.

The new rule would make status end when the job ends, restoring the original temporary nature of the visa. Comment period ends November 10, 2026.

The Poojeets are pouring into the USCIS comment section with thousands of copy-pasted sob stories about their kids, houses, and “hardship.” They’re trying to make it look like America wants to keep the 60-day free stay after they lose their job. If we don’t show up in force, their lawyers will use the comment numbers later.

I support the proposed rule to eliminate the discretionary 60-day grace period (DHS Docket No. USCIS-2026-0364). These visas are granted for a specific job with a specific employer. When that employment ends, status should end with it. The current grace period severs that connection, enables prolonged job-shopping, and disadvantages American workers. Removing it restores the temporary nature of these classifications and reduces administrative burden. I urge DHS to finalize the rule as proposed.
