Enterprises chose vendors with the lowest legal risk.
Big buyers prefer incumbents that can provide indemnities, audits, SLAs, and “safe” branding.

Platform control narrowed the field.
Cloud providers, app stores, and model marketplaces can decide which tools get reach, and that advantage compounds.

Regulation can lock in the winners.
Once rules require documentation, monitoring, evaluation, and liability handling, the firms already doing those things become the default legal suppliers.

Competition shifts from “best model” to “best permitted model.”
The market stops rewarding raw capability alone and starts rewarding compliance, distribution, and legal tolerance.

Capitalism at work
The innovators don't have to keep innovating. Why would they? That carries a risk of failure. You know what doesn't have a chance of failure? Monopoly. So instead they use their first mover advantage to get their guys in Washington and pull up the ladder behind them. They change the rules so that them winning isn't the result of being the best, it's just the only possible outcome.
