Section 535 of the Fiscal Year 2026 National Defense Authorization Act takes effect on December 18, 2026 - 69 days from now. The provision, enacted in 2025, is the first in U.S. history to automate the military conscription system.

The government has not yet released the rules that would govern how that system works. Those rules are supposed to specify which federal and state databases the automated draft can access, and who qualifies for deferments or exemptions.

The Selective Service System withdrew its proposed rules in July and has not resubmitted them.

With just over two months remaining, there are still no published guidelines. That leaves open the possibility that citizens could be selected without a clear explanation of how or why, and without a defined process for seeking a deferment or exemptions.

Even if the Selective Service submitted a Notice of Proposed Rulemaking today, the timeline would not fit. Proposed rules must undergo at least 30 days of review at the Office of Information and Regulatory Affairs, then a public comment period of 60 days. There is not enough time left before December 18 to complete both steps.

Even if the Selective Service submitted a NPRM today there is simply not enough time for the NPRM to go through the proper legally required review process at the OIRA which takes a minimum of 90 days.
Which means that Congress can invoke a military draft WITHOUT rules and regulations.

Why would they invoke it before december 18th when on and after december 18th they have unlimited power to target whatever groups they wish for the military draft? They could target the poor, they could target white males exclusively, they could target only those who live within certain geographical regions, its essentially a choose your own genocide adventure. Why wouldn't congress salivate at the thought of total power and control? That's what it means to not have any rules or regulations tied to a military draft, especially when you start "automating" the process and have enormous data on citizens from national, federal, and state databases and now have AI to quickly and efficiently search and catalogue all of those young men by any characteristics that the user desires, again this is the first time in US history this has ever happened for this reason because this kind of power is incredibly dangerous.
