You must be very careful with such a claim. If you OUGHT take my lung purely because you can, you could claim such an ought for all sorts of things: you ought steal from me because you can, you ought beat me up because you can, and so on. This sword cuts both ways - if mere capability is your justification, you cannot then turn around and cry when someone does something otherwise terrible to you. We could simply use your own ethical standards on you and say "we OUGHT shoot you dead and throw your body in a ditch for the buzzards to get at", and you could not argue against us because we're just using your own standards.

That you CAN take someone else's lung was never in question, we're questioning whether you SHOULD. Many. For one, Western society (which is what most people consider "civilized") does not base their morals and thus their laws on subjective preference. However the point here goes beyond just the lungs thing. Molyneux is using this analogy to reference boomers taking pension money from the young working people. So, in a sense, the lungs are being "stolen" with the approval of the state. Which means they aren't really being stolen, technically.
