Most soldiers aren't really trained in law enforcement. Military and civilian matters are supposed to usually remain separate.

Legally, you can use them if they're working with a federal agency like ICE or border patrol. The exta soil also supplements the wall, so you can't just cut through the metal poles, you need to actually also dig / move soil.If I was king for a day:I would also land mine the fucking thing on the Mexican side, bury them so anyone trying to dig tunnels or walk up to it will lose limbs and bleed to death in the middle of nowhere. You leave the areas near the official ports of entry alone, you just target the places that are known for tunnels and people smuggling. So you don't have to mine the entire thing, just the idea that there are mines there will change the risk calculus for some.They should use the military to do seek and destroy missions for the tunnels. That doesn't even have to be intentionally killing people, but make it their mission to just plant some explosives and cave them in. All of that ISR would be put to better use over the border, where they can use drones and infrared, even radar to find these tunnels and just destroy them. Or even bobby trap them so they collapse with explosives when people use them.

Even in an emergency, deployment of the National Guard has to be held up until formal permissions is provided by the Governor.
